'Res. 2702 <br />9/11/85 <br />from the trees to protect them from soil compaction <br />and excavation. <br />3. That the developer shall follow all recommendations <br />of the acoustical analyses prepared for this <br />project. Interior noise levels shall be no greater <br />than 45 dB Ldn. These construction techniques shall <br />be included as part of the building plan submittal. <br />4. That no building permit for of the project shall be <br />issued until such time as a contract for the <br />extension of Valley Avenue to Stanley Boulevard is <br />let and the alignment of the Del Valle Parkway <br />between Main Street and First Street is approved. <br />5. That the existing renters located on the site shall <br />be afforded the same renters relief as detailed in <br />Section 2-25.10 (Tenant Provisions) of Ordinance 980 <br />concerning Condominium Conversion Projects; existing <br />tenants shall be so notified within one week of <br />project approval. <br />6. That all building pads of the new development shall <br />essentially match the existing at grade elevations <br />along the west, north and east property lines. <br />7. That the uses and site development standards for the <br />site adhere to those standards set for RM-4000 <br />zoning districts, except that the developer may <br />propose for the Planning Director's approval <br />allowable patio area improvement requirements, such <br />as decks, spas, patio covers, etc. <br />8. That the developer file and process a tentative <br />tract map for this development. The PUD site <br />development plan will be subject to possible change, <br />at that time, with respect to utility systems and <br />topography. <br />9. That the streets within this development be private <br />drives and be maintained by a homeowner's <br />association. <br />10. That the sanitary sewer system and the water system <br />for this development be public and be within the <br />private drives and within a public service <br />easement. <br />11. That the storm drainage system within this <br />development be private and be maintained by a <br />homeowner's association. <br />12. That in the event that the physical shed boundary <br />for storm drainage and sanitary sewer extends to the <br />west beyond the development, the storm drainage and <br />sanitary sewer system should be extended through the <br />
