PLANNING COMMISSION CITY OF PLEASANTON COUNTY OF ALAMEDA STATE OF CALIFORNIA RESOLUTION N0. 2714 A RESOLUTION OF THE PLANNING COMMISSION APPROVING A CONDITIONAL USE PERMIT FOR CHURCH OF DIVINE MAN AS FILED UNDER CASE UP-85-29 WHEREAS, Church of Divine Man has applied for a conditional use permit to operate a religious institution at 328 St. Mary's Street; and WHEREAS, zoning for the property is CC (Central Commercial) District; and WHEREAS, at their duly noticed public hearing of October 23, 1985 the Planning Commission considered all public testimony, relevant exhibits and recommendations of the City staff concerning this application; and WHEREAS, the Planning Commission found a) that the proposed location of the conditional use is in accordance with the objectives of the ordinance code and the purposes of the Central Commercial District in which the site is located. The use is low profile in nature, does not disrupt nearby commercial uses and is compatible with pedestrian shopping areas; and WHEREAS, the Planning Commission found b) that the proposed location of the conditional use and the conditions under which it would be operated or maintained will not be detrimental to the public health, safety, or welfare, or materially injurious to the properties or improvements in the vicinity since noise and potential traffic conflicts would be minimal; and WHEREAS, the Planning Commission found c) that the proposed conditional use will comply with each of the applicable provisions of the ordinance code. As conditioned, the religious institutional use will conform with the parking requirements of the ordinance. NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON RESOLVES THE FOLLOWING: Section 1. Approves Case UP-85-29, application of Church of Divine Man for a conditional use permit to operate a religious institution at 328 St. Mary's Street subject to the following conditions: That religious institutional use is granted solely at the location known as 324-328 St. Mary's Street.
