Resolution No. 2733 <br />12/11/85 <br />on the west side of Foothill Road as "Low Density <br />Residential"; <br />Recommends rezoning the 316 acre site PUD (Planned <br />Unit Development) District; <br />Recommends approval of a modified conceptual <br />development plan consisting of 80 custom <br />single-family lots west of Foothill Road and 15 <br />custom single-Ofamily lots, 115 townhouses on the <br />east side of Foothill Road, including: <br />(a) that all roads be private and that no road <br />access be constructed to the staging area; <br />(b) conditioning approval such that, final map of <br />the common open areas and areas outside planned <br />grading within custom lots occupying the "bench" <br />areas be planted in random growth patterns with 5 <br />and 15 gallon trees (native species) with a support <br />drip/bubbler irrigation system at the time the first <br />final map is approved for a portion of the project, <br />that after grading, similar random plantings occur <br />along streets and within lots in a pattern to be <br />approved at the time of any tentative map including <br />streets within the "bench" areas, and that Lots 22 <br />and 23, 26, 52-60, and 63-70 be the last lots in the <br />project subdivided and offered for sale; and <br />(c) that all of the following conditions of approval for <br />GP-85-8 / PUD-85-15 as listed below are adhered to. <br />1. That the final development plan be substantially as <br />shown on the revised preliminary development plan, <br />Exhibit A, on file with the Planning Department, and <br />as modified herein. The final development plan <br />shall reflect all of the following conditions and <br />include any adjustments that must be made to the <br />preliminary development plans a result of additional <br />study. <br />2. That because of the preliminary nature of the <br />project development plan, final landscape, grading, <br />drainage, site, fencing, and any other additional <br />information referenced in the following conditions <br />shall be submitted at the time of the final <br />development plan approval for the project. The <br />final development plan submittal shall reflect the <br />appropriate applicable mitigation measures detailed <br />in the Draft EIR for the project. <br />3. That the Homeowner's Association shall enter into an <br />agreement to hold harmless, defend and indemnify the <br />City, its officers and employees from any cause of <br />action or claim for damage or injury caused by the <br />private roadways, or private utility systems, or <br />
