Res. 2751 <br />1/22/86 <br />Report, Heritage Oaks Estates" prepared by Hort <br />Science, Inc. and dated January 11, 1986, shall be <br />additional special conditions of approval of this <br />project and shall be incorporated by reference. No <br />trees shall be removed except in conformance with <br />the provisions of the Heritage Tree Ordinance. <br />18. That this case is subject to all Standard <br />Conditions of Development, attached hereto and made <br />part of this case by reference except conditions <br />12, 13, 14, 22, 25, 26, 29, 31, 33, 46, 54, and 55. <br />19. That a deep moisture probe be installed within the <br />drip line area south of the 69 inch diameter oak <br />tree and that a shallow moisture probe be installed <br />within the drip line area north (shade) of the tree <br />with a connection to an automatic irrigation <br />system; such system shall be checked biannually and <br />shall be maintained in good order for the life of <br />the tree; and that there shall be no irrigation <br />within five feet of the trunk of the tree. <br />20. That, if within five years after commencement of <br />construction on site, the 69 inch diameter oak tree <br />dies, the owner of Lot 9 shall replace said tree <br />with a similar species of 48 inch box size or <br />larger in a location to be approved by the Planning <br />Director. <br />21. That the owner of Parcel 9 shall be responsible for <br />maintenance of the 69 inch diameter oak consistent <br />with a landscape use plan approved by staff. Such <br />maintenance to be reviewed by the homeowners' <br />association semi-annually and if said maintenance <br />is deemed to be unacceptable, the homeowners' <br />association shall be responsible for maintenance. <br />These provisions are to be filed with the deed on <br />Parcel 9. <br />22. That the driveway location for Parcel 9 shall be as <br />shown on Exhibit A. <br />23. That grading on Parcel 9 shall be as shown on <br />Exhibit A except that the area to be graded shall <br />not extend outside the buildable area and that the <br />toe of slope to the natural grade shall be <br />maintained at 3:1 slope. <br />
