No trees shall be removed except in conformance with the provisions of the Heritage Tree Ordinance. 18. That this case is subject to all Standard Conditions of Development, attached hereto and made part of this case by reference except conditions 12, 13, 14, 22, 25, 26, 29, 31, 33, 46, 54, and 55. 19. That a deep moisture probe be installed within the drip line area south of the 69 inch diameter oak tree and that a shallow moisture probe be installed within the drip line area north (shade) of the tree with a connection to an automatic irrigation system; such system shall be checked biannually and shall be maintained in good order for the life of the tree; and that there shall be no irrigation within five feet of the trunk of the tree. 20. That, if within five years after commencement of construction on site, the 69 inch diameter oak tree dies, the owner of Lot 9 shall replace said tree with a similar species of 48 inch box size or larger in a location to be approved by the Planning Director. 21. That the owner of Parcel 9 shall be responsible for maintenance of the 69 inch diameter oak consistent with a landscape use plan approved by staff. Such maintenance to be reviewed by the homeowners' association semi-annually and if said maintenance is deemed to be unacceptable, the homeowners' association shall be responsible for maintenance. These provisions are to be filed with the deed on Parcel 9. 22. That the driveway location for Parcel 9 shall be as shown on Exhibit A. 23. That grading on Parcel 9 shall be as shown on Exhibit A except that the area to be graded shall not extend outside the buildable area and that the toe of slope to the natural grade shall be maintained at 3:1 slope.
