Potential of toxic spills degrading <br />surface and groundwater quality. <br />a.l Finding. The mitigation measures incorporated into <br />the Project to reduce the potential for degrading <br />of the water quality as a result of toxic spills <br />will substantially lessen the effect. <br />a.2 Fact. Condition 21 requires continued <br />consultations with Developer, Fire Marshal, City <br />Engineer and appropriate outside agencies to <br />establish procedures for safe storage and handling <br />of hazardous materials as part of the City's <br />hazardous materials ordinance. <br />a.3 Finding. The No Project Alternative, which would <br />avoid this impact, is infeasible and unnecessary <br />because the mitigation measures which have been <br />incorporated into the Project substantially lessen <br />the effect. <br />a.4 Fact. See Section XII (infeasibility of the No <br />Project Alternative). <br />B. Significant Effect. Buildout of the Tri-Valley area may <br />result in flooding along the Arroyo de la Laguna during <br />a hundred year storm. <br />b.l Finding. The mitigation measures identified in the <br />EIR such as the widening, deepening and/or concrete <br />lining of Arroyo areas, downstream channelization, <br />and use of "chain of lakes," are subject to the <br />jurisdiction of other public agencies and can and <br />should be enforced by such agencies. <br />b.2 Fact. The mitigation measures to mitigate <br />cumulative impact for Tri-Valley development are <br />subject to the jurisdiction of the Alameda County <br />Flood Control and Water Conservation District <br />(ACFCWCD). <br />b.3 Finding. The No Project Alternative, which could <br />partially mitigate the significant effect of <br />flooding is infeasible. <br />b.4 Fact. See Section XII (infeasibility of the No <br />Project Alternative). <br />IX. Biology. <br />A. Significant Effect. Loss of prime agricultural soils to <br />urbanization. <br />
