building permit may be issued until the mitigation <br />measures are either under construction or, for site <br />specific or occupant-specific mitigation measures <br />not construction-related (such as TSM), the <br />implementation programs are established. If the <br />City Engineer finds that completion of a particular <br />improvement not yet under construction will <br />reasonably be completed prior to occupancy of a <br />project building, that the improvement has received <br />all approvals necessary, from whichever agencies, <br />and that funding is bonded for or otherwise assured, <br />a building permit may be issued in advance of the <br />start of construction of the mitigation measure. <br />(ii) If the traffic study analysis shows any <br />affected intersection, or intersections, would exceed <br />LOS D (equal to or greater than 91% of capacity), and <br />indicates that there are no mitigation measures the <br />Developer can implement to improve that intersection(s) <br />to mid-LOS D (86% of capacity), then the City shall not <br />approve the project application. <br />17. Groundwater Test Wells. The developer shall install <br />test wells within the project site; scheduled <br />groundwater monitoring in accordance with the <br />requirements established by the Environmental <br />Monitoring Committee shall be conducted by the <br />Property owner's Association or by some other agency <br />satisfactory to the City Engineer, at the <br />Developer's expense. The location and number of <br />test wells shall be determined by the City Engineer. <br />18. Air Quality Analysis. The City, at developer <br />expense, shall hire a qualified atmospheric <br />scientist or air pollution expert to evaluate <br />project-generated air quality impacts, establish air <br />quality standards to minimize air quality impacts <br />from the project and to ensure that state and <br />federal standards for primary pollutants are met at <br />the site and along access routes, and develop a <br />monitoring program which can be used to evaluate air <br />quality impacts as the project develops. In the <br />event such standards would be exceeded by any <br />incremental development proposal, that particular <br />project shall not be approved. <br />19. Noise Analysis. The City, at Developer's expense, <br />shall hire a qualified acoustical expert to evaluate <br />project-generated noise impacts, including <br />cumulative impacts, and to conduct follow-up noise <br />analysis of Developer-installed mitigation measures <br />to ensure compliance with the City's adopted <br />exterior noise standards. Noise mitigation shall <br />extend to those areas studied for noise mitigation <br />in the North Pleasanton Traffic Improvement District <br />environmental impact report. <br />- 7 - <br />
