6.52.110 <br />held, grantee shall, upon written grantor <br />request, submit a copy of grantee's or <br />grantee's parent's publicly filed annual <br />or quarterly financial statement within <br />forty five (45) days of such a request. <br />5. Upon grantor's written request, <br />but no more than annually, grantee <br />shall submit to grantor a privacy report <br />indicating the degree of compliance <br />with the provisions contained in subsec- <br />tions 6.52.160C3, C4 and C6 of this <br />chapter and all steps taken to assure <br />that the privacy rights of individuals <br />have been protected. <br />6. All reports required under this <br />chapter, except those required by law to <br />be kept confidential, shall be available <br />for public inspection in the grantor's <br />offices during normal business hours. <br />7. All reports and records required to <br />be delivered to grantor under this chap- <br />ter shall be furnished at the sole ex- <br />pense of grantee, except as otherwise <br />provided in the franchise agreement. <br />8. The wilful refusal, failure, or wil- <br />ful negligence of grantee to file any of <br />the reports required as and when due <br />under this chapter, may be deemed a <br />material breach of the franchise agree- <br />ment if such reports are not provided to <br />grantor within sixty (60) days after <br />written request therefor, and may sub- <br />ject the grantee to all remedies, legal or <br />equitable, which are available to grant- <br />or under this chapter or the franchise <br />agreement. <br />9. Any materially false or misleading <br />statement or representation made know- <br />ingly and wilfully by the grantee in any <br />report required under this chapter or <br />under the franchise agreement may be <br />deemed a material breach of the fran- <br />chise and may subject grantee to all <br />remedies, legal or equitable, which are <br />available to grantor. <br />C. Record Maps: Within sixty (60) <br />calendar days of a written request from <br />grantor, grantee shall provide grantor <br />with a full and complete set of plans <br />and record drawings showing the loca- <br />tions of the cable system installed or in <br />use in the city, exclusive of subscriber <br />service drops and equipment provided <br />in subscribers' homes. It is the intent of <br />this section that the grantor have a <br />complete set of plans and record draw- <br />ings. After the initial submission of a <br />complete set of drawings, the grantee <br />shall provide to grantor updated por- <br />tions of those sections of the drawings <br />that have changed, within sixty (60) <br />calendar days of the change. <br />D. Opinion Survey: Upon written re- <br />quest of the grantor, but not more than <br />once every two (2) years, the grantee <br />shall conduct a subscriber satisfaction <br />survey pertaining to quality of service, <br />which may be transmitted to subscrib- <br />ers in grantee's invoice for cable ser- <br />vices. The results of such survey shall <br />be provided to the grantor on a timely <br />basis. The cost of such survey shall be <br />borne by the grantee.
