17.36.040 <br />17.36.040 Exemptions: <br />This chapter shall not be applicable <br />to the following categories of residen- <br />tial units: <br />A. Second units approved in accor- <br />dance with city zoning regulations. <br />B. Mobilehomes and/or living quar- <br />ters located on school sites, public and <br />institutional properties, and commer- <br />cial/industrial properties used for secu- <br />rity purposes or other purposes ancil- <br />lary to the primary use, the use of <br />which has been approved in accordance <br />with city zoning regulations, when such <br />residential units do not exceed one <br />dwelling per site. <br />C. A condominium conversion or <br />replacement unit of an existing unit <br />demolished and/or destroyed. (Ord. <br />1729 § 2, 1997) <br />17.36.050 Administration Of The <br />Growth Management <br />Program: <br />A. Review Of Annual Growth Man- <br />agement Report: <br />1. An annual growth management <br />report shall be prepared which shall <br />include: <br />a. Historical building permit activity; <br />b. Projections of likely building <br />activity within the city by category of <br />project; <br />c. Estimates of new projects which <br />may seek approval in the following <br />year or years; <br />d. Analysis of the capability of infra- <br />structure and services to meet the de- <br />mands of new residential development, <br />including any changes to established <br />conditions and/or measures designed to <br />mitigate the adverse effects of new <br />residential development; and <br />e. Progress toward meeting city gen- <br />eral plan goals and policies. <br />2. An annual growth management <br />report shall be presented to the plan- <br />ning commission for its review. The <br />planning commission shall make rec- <br />ommendations to the city council re- <br />garding the annual growth management <br />report, including, but not limited to, <br />annual allocation issues. <br />3. The city council shall receive and <br />review an annual growth management <br />report, and the recommendations of the <br />planning commission. The city <br />council's review of an annual growth <br />management report should coincide <br />with the council's review of requests <br />for modifications of major project allo- <br />cations and should occur at the coun- <br />cil's second meeting in September. The <br />city council may schedule such review <br />at any time during the year should <br />changed circumstances relating to the <br />provision of planned infrastructure <br />and/or services require a review and <br />possible modification to the growth <br />management program. <br />B. Annual Review: <br />1. The city council, following review <br />of the annual growth management re- <br />port, shall have the following duties <br />and powers: <br />a. Determine whether the annual new <br />residential unit limits require adjust- <br />ment downward due to infrastructure/ <br />service constraints. <br />b. Determine whether to adjust for <br />the future the suballocations established <br />455 (Pleasanton April 2001) <br />
