18.106.060 <br />including multi-family residential lots in <br />planned unit developments, upon the <br />granting of a conditional use permit. <br />A. Detached second units on multi- <br />family residential lots shall not exceed <br />fifteen feet (15') in height, shall be limit- <br />ed to one story structures, and shall meet <br />the following minimum setback require- <br />ments: <br />1. Side yard setback shall be ten feet <br />(10') on the street side of a corner lot and <br />five feet (5') on all other side yards; <br />2. Reaz yazd setback shall be ten feet <br />(10'). <br />B. Detached second units on multi- <br />family residential lots shall meet the open <br />space requirement as required for apart- <br />ments with the same number of bedrooms <br />in the applicable zoning district(s). <br />C. Except as modified by this chapter, <br />all other regulations embodied in the <br />zoning of the property for class I accesso- <br />ry structures shall apply to the develop- <br />ment of detached second units on multi- <br />family residential lots. (Ord. 1812 § 1, <br />2000) <br />18.106.070 Required Conditions: <br />All conditional use permits for second <br />units shall include, but not be limited to, <br />the following conditions: <br />A. Only one residential unit on the <br />subject parcel may be rented. Only one <br />other residential unit shall be permitted on <br />a lot with a second unit and the other <br />residential unit shall be owner-occupied. <br />The resident owner shall be a signatory to <br />any lease for the second unit. <br />B. The second unit shall not be sold, <br />subdivided, or held under a different legal <br />ownership than the primary residence. <br />C. The second unit shall not be occu- <br />pied by more than two (2) adults, and <br />only the number of children permitted by <br />law. <br />D. Design modifications may be made <br />to an approved second unit, if the zoning <br />administrator determines that the modifi- <br />cations are minor and in substantial con- <br />formance with the approved design and <br />use permit. <br />E. One additional off-street parking <br />space at the parcel shall be made continu- <br />ously available to the occupants of the <br />second unit. <br />F. The maximum floor area ratio re- <br />quirement of a lot shall not be exceeded <br />due to the addition/conversion of space to <br />accommodate an attached or detached <br />second unit. <br />G. The gross floor area of a detached <br />second unit shall not exceed one thousand <br />two hundred (1,200) squaze feet. (See also <br />subsection F of this section.) <br />H. The gross floor azea of an attached <br />second unit shall not exceed thirty percent <br />(30%) of the gross floor area of the exist- <br />ing main dwelling unit. In this instance, <br />the gross floor area of the existing main <br />dwelling unit is the size of the unit prior <br />to the second unit addition/conversion. <br />(See also subsection F of this section.) <br />I. The resident owner shall install ad- <br />dress signs that are clearly visible from <br />the street during both daytime and eve- <br />ning hours and which plainly indicate that <br />two (2) separate units exist on the parcel, <br />as required by the fire marshal. The resi- <br />dent owner shall obtain the new street <br />address for the second unit from the plan- <br />ning department. <br />7.
