11.44.040 <br />ize the maintenance of a public or <br />private nuisance as defined under provi- <br />sions of law other than chapter 10 <br />(commencing with section 22650) of <br />division 11 of the Vehicle Code and <br />this Chapter. (Prior Code Art. 1 <br />§ 5-7.04) <br />persons shall be authorized to enter <br />upon private property or public proper- <br />ty to remove or cause the removal of a <br />vehicle or parts thereof declared to be a <br />nuisance pursuant to this Chapter. (Ord. <br />1797 § 1, 1999; Prior Code Art. 1 <br />§ 5-7.07) <br />11.44.050 Other Remedies: <br />This Chapter is not the exclusive <br />regulation of abandoned, wrecked, <br />dismantled or inoperative vehicles <br />within the City. It shall supplement and <br />be in addition to the other regulatory <br />codes, statutes, and ordinances hereto- <br />fore or hereafter enacted by the City, <br />the State, or any other legal entity or <br />agency having jurisdiction. (Prior Code <br />Art. 1 § 5-7.05) <br />11.44.060 Enforcement: <br />Except as otherwise provided herein, <br />this Chapter shall be administered and <br />enforced by the Chief of Police. To en- <br />force this Chapter, the Chief of Police <br />may enter upon private property to <br />examine a vehicle, or parts thereof, or <br />obtain information as to the identity of <br />a vehicle to determine whether the <br />vehicle is abandoned, wrecked, disman- <br />tled, or inoperative, and therefore, a <br />public nuisance under this Chapter. <br />(Ord. 1797 § 1, 1999; Prior Code Art. 1 <br />§ 5-7.06) <br />11.44.070 Authorized Removal By A <br />Franchise: <br />When the City Council has contract- <br />ed with or granted a franchise to any <br />person or persons, such person or <br />11.44.080 Administrative Costs: <br />The City Council shall from time to <br />time determine and fix an amount to be <br />assessed as administrative costs which <br />may exclude the actual cost of removal <br />of any vehicle or parts thereof under <br />this Chapter. Upon discovering the existence of <br />an abandoned, wrecked, dismantled, or <br />inoperative vehicle, or parts thereof, on <br />private property or public property <br />within the City, the Chief of Police <br />shall have the authority to cause the <br />abatement and removal thereof in ac- <br />cordance with the procedure prescribed <br />in this Chapter. <br />B. The City, its officers, employees <br />and agents shall not be liable for any <br />damage caused to the vehicle, or parts <br />thereof, by removal pursuant to this <br />Chapter.
