x.08.010 <br />Chapter 7.08 <br />ANIMAL NUISANCES <br />Sections: <br />7.08.010 Designated <br />7.08.020 Violation -Penalty <br />7.08.010 Designated: <br />It is unlawful and a nuisance for any <br />person owning, keeping or having the <br />care or custody of any animal to know- <br />ingly permit or suffer, allow or tolerate <br />the animal, by any barking or other <br />noise or sound of loudness, duration <br />and location, to disturb any reasonable <br />person's peace and quiet. This Section <br />shall not be construed to prohibit the <br />keeping of any watchdog, provided the <br />keeper thereof takes immediate steps to <br />quiet the dog whenever it barks; and <br />provided such keeper never leaves such <br />dog unattended on the premises in a <br />place where its barking would disturb a <br />reasonable person's peace and quiet. <br />(Ord. 1131 § 1, 1984; Prior Code <br />§ 4-3.8.1) <br />7.08.020 Violation -Penalty: <br />A. Infraction -First Three Violations <br />In Twelve Month Period: Any person <br />who violates a provision of this Chapter <br />shall be guilty of an infraction punish- <br />able in accordance with Section <br />1.12.020 of this Code. <br />B. Misdemeanor -More Than Three <br />Violations In Twelve Month Period: <br />Any person who violates a provision of <br />this Chapter more than three (3) times <br />in any twelve (12) month period shall <br />be guilty of a misdemeanor punishable <br />as provided in Section 1.12.010 of this <br />Code.
