6.40.030 <br />In reaching a decision, the Chief of <br />Police shall consider: <br />1. The character, experience and <br />responsibility of the applicant. <br />2. Whether the applicant complies <br />with the conditions of mandatory con- <br />trolled substance/alcohol testing as set <br />forth in section 53075.5 of the Govern- <br />ment Code and outlined in Section <br />6.40.105 of this Chapter. <br />3. Any other information the Chief <br />of Police deems pertinent to the issu- <br />ance of a certificate. (Ord. 1744 § 1, <br />1998) <br />6.40.040 Certificate Appeal: <br />Any person may appeal the decision <br />of the Chief of Police, by filing a writ- <br />ten notice of appeal, stating the basis of <br />the appeal, with the City Clerk within <br />five (5) days after the Chief of Police's <br />decision. Such appeal shall be heard by <br />the City Manager within thirty (30) <br />days. The City Manager may affirm, <br />amend, or reverse the decision, or take <br />other action deemed appropriate after <br />receiving oral or written testimony from <br />the appellant, the certificate holder, the <br />Chief of Police, and all interested per- <br />sons. In conducting the public hearing, <br />the City Manager shall not be limited <br />by the formal rules of evidence. The <br />hearing shall be de novo. (Ord. 1744 <br />§ 1, 1998) <br />6.40.050 Liability Insurance <br />Required: <br />Before the Chief of Police issues the <br />certificate, there shall be in full force <br />and in effect insurance for each autho- <br />rized vehicle in the amount of at least <br />one million dollars ($1,000,000.00) for <br />injuries sustained in any one accident; <br />and one hundred thousand dollars <br />($100,000.00) for property damage re- <br />sulting from any one accident. Said <br />insurance shall benefit any person who <br />shall be injured or who shall sustain <br />damage to property caused by the negli- <br />gence of a certificate holder, and/or the <br />holder's employees or agents. Said <br />insurance certificate shall be filed with <br />the Police Department and shall be with <br />an insurance company authorized to do <br />business as provided in subsection <br />6.40.020H of this Chapter. (Ord. 1744 <br />§ 1, 1998) <br />6.40.065 Location Within The City <br />Required: <br />A. Within one year from the date <br />that a certificate is issued, and thereaf- <br />ter all the time that the certificate is in <br />force, the owner shall provide evidence <br />that the owner has obtained a site with- <br />in the City where drivers shall park <br />their taxicabs when not in use or when <br />waiting to be dispatched. Such evidence <br />must include a zoning certificate for the <br />site. <br />B. An owner's failure to provide <br />such evidence shall be grounds for the <br />certificate to be suspended or revoked. <br />(Ord. 1744 § 1, 1998) <br />6.40.070 License Fees: <br />Before the Chief of Police issues the <br />certificate, the applicant shall pay the <br />(Pleasanton 5-99) 1']$ <br />
