6.40.020 for which application for a certificate is made. E. A description of the proposed color scheme, insignia or any other dis- tinguishing characteristics of the taxi- cab. F. The proposed schedule of rates, which shall not exceed those fees estab- lished and set by resolution of the City Council. G. An application fee as set forth in the Master Fee Scheduler, that shall accompany each application fora cer- tificate of public convenience and ne- cessity. H. A copy of the certificate of insur- ance for the business and taxicabs, or a written statement from the insurance company agreeing to provide insurance should the application be granted. This insurance company shall be headquar- tered in the United States, authorized by the State to provide insurance in this State and approved by the City Attor- ney as to its financial status. I. A copy of the Federal Communi- cation Commission license to operate a base and mobile radio units. J. A statement of personal business history regarding taxicab opera- tions/ownership. K. A statement as to whether the applicant has ever been denied a Mu- nicipal taxi permit, or if it was issued whether it was ever suspended or re- voked, and if yes, why. L. Such other additional information as the Chief of Police may reasonably require. (Ord. 1744 § 1, 1998) 6.40.030 Procedure On Application And Hearing: A. Publication Of Application: Upon the filing of any application fora cer- tificate with the Chief of Police, notice thereof shall be published one time in a local newspaper of general circulation. B. Protest And Hearing: Persons interested or protesting an application should notify the Chief of Police in writing within five (5) business days of the publishing of said notice of applica- tion. Within thirty (30) days of receipt of a written protest, the Chief of Police shall convene a hearing regarding said application. At the hearing, parties shall not be bound by the formal rules of evidence. The Chief of Police shall hear the information submitted by the pro- testing party, any interested party, and the applicant. The Chief of Police shall issue a written decision no later than ten (10) business days following the hearing. Such decision shall be support- ed by the findings set forth in subsec- tion C of this Section. C. Findings Of Decision: The Chief of Police shall issue or deny such cer- tificate after investigating the applicant and the facts set forth in the applica- tion. If the Chief of Police finds that the applicant is fit, willing and able to meet the provisions of this Chapter and any and all rules promulgated by the Chief of Police, then the Chief of Po- lice shall issue a certificate stating the name and address of the applicant, and the date of issuance; otherwise, the application shall be denied. 1.
