6.40.020 <br />for which application for a certificate is <br />made. <br />E. A description of the proposed <br />color scheme, insignia or any other dis- <br />tinguishing characteristics of the taxi- <br />cab. <br />F. The proposed schedule of rates, <br />which shall not exceed those fees estab- <br />lished and set by resolution of the City <br />Council. <br />G. An application fee as set forth in <br />the Master Fee Scheduler, that shall <br />accompany each application fora cer- <br />tificate of public convenience and ne- <br />cessity. <br />H. A copy of the certificate of insur- <br />ance for the business and taxicabs, or a <br />written statement from the insurance <br />company agreeing to provide insurance <br />should the application be granted. This <br />insurance company shall be headquar- <br />tered in the United States, authorized <br />by the State to provide insurance in this <br />State and approved by the City Attor- <br />ney as to its financial status. <br />I. A copy of the Federal Communi- <br />cation Commission license to operate a <br />base and mobile radio units. <br />J. A statement of personal business <br />history regarding taxicab opera- <br />tions/ownership. <br />K. A statement as to whether the <br />applicant has ever been denied a Mu- <br />nicipal taxi permit, or if it was issued <br />whether it was ever suspended or re- <br />voked, and if yes, why. <br />L. Such other additional information <br />as the Chief of Police may reasonably <br />require. (Ord. 1744 § 1, 1998) <br />6.40.030 Procedure On Application <br />And Hearing: <br />A. Publication Of Application: Upon <br />the filing of any application fora cer- <br />tificate with the Chief of Police, notice <br />thereof shall be published one time in a <br />local newspaper of general circulation. <br />B. Protest And Hearing: Persons <br />interested or protesting an application <br />should notify the Chief of Police in <br />writing within five (5) business days of <br />the publishing of said notice of applica- <br />tion. <br />Within thirty (30) days of receipt of <br />a written protest, the Chief of Police <br />shall convene a hearing regarding said <br />application. At the hearing, parties shall <br />not be bound by the formal rules of <br />evidence. The Chief of Police shall hear <br />the information submitted by the pro- <br />testing party, any interested party, and <br />the applicant. The Chief of Police shall <br />issue a written decision no later than <br />ten (10) business days following the <br />hearing. Such decision shall be support- <br />ed by the findings set forth in subsec- <br />tion C of this Section. <br />C. Findings Of Decision: The Chief <br />of Police shall issue or deny such cer- <br />tificate after investigating the applicant <br />and the facts set forth in the applica- <br />tion. If the Chief of Police finds that <br />the applicant is fit, willing and able to <br />meet the provisions of this Chapter and <br />any and all rules promulgated by the <br />Chief of Police, then the Chief of Po- <br />lice shall issue a certificate stating the <br />name and address of the applicant, and <br />the date of issuance; otherwise, the <br />application shall be denied. <br />1.
