(Ord. 1772 § 3, 1999) <br />3.40.020 Application: <br />This Chapter applies to special fees <br />charged as a condition of development to <br />defray the cost of specified public infra- <br />structure facilities required to serve new <br />development within the North Sycamore <br />Specific Plan Area, as delineated by the <br />boundaries of the adopted City of <br />Pleasanton North Sycamore Specific Plan, <br />and certain adjacent areas. The fees <br />charged under this Chapter do not replace <br />subdivision map exactions or other mea- <br />sures required to mitigate site-specific <br />impacts of a development project; other <br />regulatory, development and processing <br />fees; funding required pursuant to a de- <br />velopment agreement or reimbursement <br />agreement for amounts that may exceed a <br />development's proportional share of infra- <br />structure costs; assessments charged pur- <br />suant to special assessment or benefit <br />assessment district proceedings; or proper- <br />ty taxes, unless so specified. (Ord. 1772 <br />§ 3, 1999) <br />3.40.030 Definitions: <br />In this Chapter: <br />A. "North Sycamore Specific Plan Ar- <br />ea" includes an approximate 135.2 acre <br />area as set forth in the Pleasanton North <br />Sycamore Specific Plan (figure II-4, Par- <br />cel Identification Map, parcel numbers 1 <br />through 25) and as shown on Exhibit A at <br />the end of this Chapter. <br />B. "Basic infrastructure program" is a <br />capital improvement plan containing a list <br />and schedule of public facilities that can <br />be funded by the North Sycamore Area <br />development impact fee. The basic infra- <br />structure program is included in the tech- <br />nical report, a report prepared by Eco- <br />nomic and Planning Systems, Inc., enti- <br />tled "Infrastructure Financing Plan and <br />Technical Report for the North Sycamore <br />Specific Plan", dated December 1, 1998. <br />C.
