3.28.020 <br />1. Minimum Number Of Proposals: <br />Open market purchases shall, wherever <br />possible, be based on at least three (3) <br />bids, and shall be awarded to the lowest <br />responsible bidder. <br />2. Notice Inviting Proposals: Bids <br />shall be solicited by written requests to <br />responsible vendors or by telephone. <br />3. Written Proposals: Written propo- <br />sals shall be submitted and a record <br />shall be kept of all open market orders <br />and proposals for a period of one year <br />after the submission of proposals or the <br />placing of orders. This record, while so <br />kept, shall be open to public inspection. <br />(Prior Code § 1-2.38) <br />3.28.030 Care, Restitution, Sale Or <br />Destruction Of Unclaimed <br />Property: <br />A. Unclaimed property as defined in <br />Penal Code section 1411 and held by <br />the Police Department for a period of at <br />least three (3) months shall be sold at a <br />public auction to the highest bidder. At <br />least five (5) days prior to the date of <br />the auction, a notice of the auction <br />shall be published in a newspaper of <br />general circulation. <br />B. If the City's purchasing agent de- <br />termines that any such unclaimed prop- <br />erty held by the City for sale is needed <br />for a public use, such property may be <br />retained by the City and need not be <br />sold. Property retained by the City shall <br />thereafter not be redeemed by the own- <br />er or by any other person entitled to <br />possession. <br />C. Notwithstanding subsections A <br />and B of this Section and notwithstand- <br />ing the provisions of Administrative <br />Directive No. 28-307, as amended (the <br />Guidelines for Disposition of Un- <br />claimed Property), any bicycles or toys <br />or both, in the possession of the Police <br />Department, which have been un- <br />claimed for a period of at least ninety <br />(90) days, may be turned over to the <br />Alameda County Probation Officer, to <br />the Welfare Department of Alameda <br />County or to any charitable or nonprofit <br />organization which is authorized under <br />its articles of incorporation to partici- <br />pate in a program or activity designed <br />to prevent juvenile delinquency.
