6.24.020 <br />techniques, and which provides a diplo- <br />ma or certificate of graduation upon <br />successful completion of such course of <br />study or course work recognized by <br />national- professional massage or body <br />therapy organizations. If said school or <br />institution of learning is not located in <br />the State of California, it shall comply <br />with standards commensurate with <br />those required in California Education <br />Code section 94311 and shall obtain <br />approval under any similar State ap- <br />proval program, if such exists. Any <br />school or institution of learning offer- <br />ing or allowing correspondence course <br />credit not requiring actual attendance at <br />class, or a course of massage not ap- <br />proved by the California Department of <br />Education shall not be deemed a "rec- <br />ognized school of massage". (Ord. 1727 <br />§ 2, 1997) <br />6.24.030 Permit Requirement: <br />A. Massage Establishment Permit: <br />Except as otherwise provided in Section <br />6.24.040 and subsection 6.24.220B of <br />this Chapter, it shall be unlawful for <br />any person to engage in, conduct or <br />carry on, or permit to be engaged in, <br />conducted or carried on, in or upon any <br />premises within the City, the operation <br />of a massage establishment without first <br />having obtained a massage establish- <br />ment permit issued by the Police Chief <br />pursuant to this Chapter. A separate <br />permit shall be obtained for each sepa- <br />rate massage establishment. <br />B. Massage Technician Permit: <br />Except as otherwise provided in Section <br />6.24.040 and subsection 6.24.220B of <br />this Chapter, it shall be unlawful for <br />any person to engage in, conduct or <br />carry on the function of a massage <br />technician without first having obtained <br />a massage technician permit issued by <br />the Police Chief pursuant to this Chap- <br />ter. <br />C. Provisional Permit: The Police <br />Chief may issue a provisional permit to <br />any applicant, for a period not to ex- <br />ceed six (6) months, if the applicant <br />requires experience in the massage <br />profession for the purpose of eligibility <br />for a certification examination as pro- <br />vided in subsection 6.24.OSOA of this <br />Chapter or for educational requirements <br />for a recognized school of massage, and <br />the applicant shows proof of satisfacto- <br />ry completion of at least three hundred <br />(300) hours of a nonrepetitive curricu- <br />lum in anatomy, physiology, hygiene, <br />sanitation, and massage theory, history, <br />ethics, and practice from a recognized <br />school of massage. <br />D. Additional Permits: Permits re- <br />quired under this Chapter shall be in <br />addition to any other license, permit, or <br />requirement required under Federal, <br />State, or City law or regulation. A <br />permit issued under this Chapter does <br />not authorize the permittee to practice <br />massage until the permittee has com- <br />plied with all business license require- <br />ments, zoning/planning requirements, <br />and all other applicable Federal, State, <br />and City laws or regulations.
