7.04.010 <br />Chapter 7.04 <br />GENERAL PROVISIONS' <br />Sections: <br />7.04.010 Title <br />7.04.020 Definitions <br />7.04.010 Title: <br />This title shall be known as ANIMAL <br />CONTROL. (Ord. 1919 § 1, 2005) <br />7.04.020 Definitions: <br />For the purpose of this title, unless it <br />is plainly evident from the context that <br />a different meaning is intended, certain <br />terms used in this title are defined as <br />follows: <br />A. "Animal" means any mammal in- <br />cluding, but not limited to, horse, cow, <br />goat, sheep, dog and cat. <br />B. "Animal control agency" means <br />the police department of the city. <br />C. "At large" means a dog that: <br />1. Is on or in any public property; or <br />2. Is on or in any private property <br />other than that of the owner of the dog <br />unless the person in charge of the pri- <br />vate property has consented to the dog <br />being on such private property; and <br />3. Is not securely restrained by a <br />substantial leash, not to exceed six feet <br />(6') if the leash is nonretractable or <br />thirty feet (30') in length if the leash is <br />retractable; or <br />4. Is securely restrained as provided <br />in subsection C3 of this section but is <br />not physically controlled by the owner <br />of the dog. <br />For purposes of this title, any dog in <br />or on any vehicle shall be deemed to be <br />on or in the private property of the <br />owner and deemed to be securely re- <br />strained and under the physical control <br />of the owner. <br />D. "Chief of police" means the chief <br />of police of the city or the chief of <br />police's designee. <br />E. "Director" means the chief of <br />police. <br />F. "Dog" means any member of the <br />canine family, and shall include female <br />as well as male dogs. <br />G. "Fees and charges resolution" <br />means the resolution establishing fees <br />and charges adopted by the city <br />council2. <br />H. "Health officer" means the chief <br />of police. <br />I. "Horse" means and includes mule, <br />burro, pony, jack, hinny or jenny. <br />J. "Owner" means any person, firm <br />or corporation owning, having an inter- <br />est in, keeping, or having charge, con- <br />trol, custody, or possession of any ani- <br />mal. <br />K. "Shelter" means a facility desig- <br />nated by the chief of police for im- <br />poundment of animals, and (depending <br />on context) the persons who staff such <br />facility.
