The provisions of this chapter aze <br />intended to provide a vehicle pursuant <br />to which dogs found, following a heaz- <br />ing at which oral and documentary <br />evidence is considered, to be a public <br />nuisance may be removed from the city <br />or otherwise abated. This chapter is <br />intended to supplement rather than sup- <br />plant any other remedy available either <br />under state law or city ordinance. (Ord. <br />1205 § 2, 1985; Prior Code § 4-6.10) <br />7.20.020 Vicious Dog Defined: <br />A "vicious dog" shall mean a dog <br />with a propensity to bite human beings <br />or other animals. In determining wheth- <br />er adog is vicious, the following fac- <br />tors shall be considered: <br />A. Whether and how many times the <br />dog has bitten human beings; <br />B. Whether and how many times the <br />dog has bitten other animals; <br />C. Whether a biting or bitings have <br />occurred while the dog was under the <br />control or on the property of the owner <br />thereof; <br />D. The severity of any bite or <br />bitings; <br />E. The circumstances surrounding <br />any bite or bitings, including, but not <br />limited to, whether the dog was pro- <br />voked, whether the biting or bitings <br />occurred during play with the animal <br />and density of population in the azea in <br />which the dog is kept; <br />F. Such other circumstances and <br />consideration deemed relevant to the <br />questions of whether or not the dog is <br />vicious. (Ord. 1205 § 2, 1985; Prior <br />Code § 4-6.11) <br />7.20.030 Investigation: <br />Any dog quazantined pursuant to <br />section 7.32.010 of this title for biting a <br />human being or other animal shall be <br />investigated by the health officer. In <br />cases in which the owner of the dog <br />refuses to cooperate in the investiga- <br />tion, the health officer may request the <br />assistance of the city police. If, based <br />on the investigation, the health officer <br />concludes there is probable cause to <br />200_ 1 (Pleasanton January 2006) <br />
