(Ord. 1869 § 3, 2002; <br />Prior Code § 2-13.33) <br />20.12.060 Variances: <br />The chief building official shall have <br />the power to grant a variance to any of <br />the provisions of the adopted uniform <br />plumbing code upon application, in <br />writing, by the affected party or his <br />duly authorized agent, when there are <br />practical difficulties in the way of car- <br />rying out the strict letter of the code; <br />provided, that the spirit of the code <br />shall be observed, public health, safety <br />and welfare secured and substantial jus- <br />tice done. The particulars of such vazi- <br />ance and the decision of the chief <br />building official shall be entered in the <br />records of the public works department <br />of the city and a signed copy furnished <br />the applicant. The granting of any <br />variance shall not be construed to imply <br />or fix any liability on the part of the <br />city or any officer or employee thereof <br />for any damages to persons or property <br />by reason of such variance. (Ord. 1869 <br />§ 3, 2002; Prior Code § 2-13.34) <br />20.12.070 Appeals: <br />Whenever the chief building official <br />shall disapprove an application or re- <br />fuse to grant a permit applied for, or <br />when it is claimed that the provisions <br />of the code or this chapter do not apply <br />or that the true intent or meaning of the <br />code has been misconstrued or wrongly <br />interpreted, the applicant may appeal <br />from the decision of the chief building <br />official to the city manager within <br />thirty (30) days from the date of the <br />decision appealed. Such appeal shall be <br />in writing and the city manager shall <br />within thirty (30) days of the receipt of <br />the appeal and by written notice to the <br />appellant either uphold, reverse or <br />modify the decision of the chief build- <br />ing official. The decision of the city <br />manager may be appealed within thirty <br />(30) days of said decision to the board <br />of appeals established by section <br />20.12.080 of this chapter. (Ord. 1869 <br />§ 3, 2002; Prior Code § 2-13.35) <br />20.12.080 Board Of Appeals - <br />Established: <br />There is created and established a <br />board of appeals consisting of five (5) <br />members. Each member of the board of <br />appeals shall be appointed by the coun- <br />cil for a term of two (2) years; provid- <br />ed, that the first two (2) members ap- <br />pointed shall serve a term of one year. <br />The board shall elect a chairman. The <br />chief building official or his representa- <br />tive shall be an ex officio member of <br />said board and shall serve as secretary. <br />The board shall adopt reasonable rules <br />and regulations for conducting its busi- <br />ness. Any board of appeals appointed <br />by the city council under the provisions <br />of any other ordinance may act as the <br />board of appeals provided for in this <br />chapter when so directed by resolution <br />of the city council.
