20.12.050 the office of the public works depart- ment, which record shall be available to interested parties. (Ord. 1869 § 3, 2002; Prior Code § 2-13.33) 20.12.060 Variances: The chief building official shall have the power to grant a variance to any of the provisions of the adopted uniform plumbing code upon application, in writing, by the affected party or his duly authorized agent, when there are practical difficulties in the way of car- rying out the strict letter of the code; provided, that the spirit of the code shall be observed, public health, safety and welfare secured and substantial jus- tice done. The particulars of such vazi- ance and the decision of the chief building official shall be entered in the records of the public works department of the city and a signed copy furnished the applicant. The granting of any variance shall not be construed to imply or fix any liability on the part of the city or any officer or employee thereof for any damages to persons or property by reason of such variance. (Ord. 1869 § 3, 2002; Prior Code § 2-13.34) 20.12.070 Appeals: Whenever the chief building official shall disapprove an application or re- fuse to grant a permit applied for, or when it is claimed that the provisions of the code or this chapter do not apply or that the true intent or meaning of the code has been misconstrued or wrongly interpreted, the applicant may appeal from the decision of the chief building official to the city manager within thirty (30) days from the date of the decision appealed. Such appeal shall be in writing and the city manager shall within thirty (30) days of the receipt of the appeal and by written notice to the appellant either uphold, reverse or modify the decision of the chief build- ing official. The decision of the city manager may be appealed within thirty (30) days of said decision to the board of appeals established by section 20.12.080 of this chapter. (Ord. 1869 § 3, 2002; Prior Code § 2-13.35) 20.12.080 Board Of Appeals - Established: There is created and established a board of appeals consisting of five (5) members. Each member of the board of appeals shall be appointed by the coun- cil for a term of two (2) years; provid- ed, that the first two (2) members ap- pointed shall serve a term of one year. The board shall elect a chairman. The chief building official or his representa- tive shall be an ex officio member of said board and shall serve as secretary. The board shall adopt reasonable rules and regulations for conducting its busi- ness. Any board of appeals appointed by the city council under the provisions of any other ordinance may act as the board of appeals provided for in this chapter when so directed by resolution of the city council.
