AGREEMENT <br /> <br /> REGARDING IMPLEMENTATION OF NONPOINT SOURCE CONTROL EVALUATION PROGRAM <br /> <br /> Alameda County Flood Control and Water Conservation District, a local <br /> public agency of the State of California: <br /> <br /> City of Alameda, a municipality of the State of California; <br /> City of Albany, a municipality of the State of California; <br /> City of Berkeley, a municipality of the State of California; <br /> City of Dublin, a municipality of the State of California; <br /> City of Livermore, a municipality of the State of California; <br /> City of Piedmont, a municipality of the State of California; <br /> City of Pleasanton, a municipality of the State of California; <br /> <br /> AGREE this day of , I988, as follows: <br />RECITALS: <br /> <br /> A. The San Francisco Bay Regional Water Quality Control Board, having <br />accepted a nonpoint source control evaluation plan from Alameda County, <br />requires that local agencies in the County of Alameda, including the <br />parties to this agreement, shall implement and complete the evaluation plan <br />by June 30, lggl. <br /> <br /> B. This agreement will provide for the allocation of responsibility <br />for the work and for distribution of the costs allocated to the seven <br />cities not in an Alameda County Flood Control Zone where benefit assessment <br />fees are paid. <br /> <br />AGREEMENT~ <br /> <br /> 1. In accordance with the Water Quality Control Plan for the San <br />Francisco Bay Basin (Basin Plan), the Alameda Count~ Flood Control and <br />Water Conservation District {hereinafter District is assuming a sig- <br />nificant coordination role in the implementation of this program and shall <br />undertake to secure the services of a consultant in accordance with <br />District procedures on selection of professional consultants. The <br />District's contract with the consultant will contain a hold harmless and <br />indemnity provision for the benefit of all parties to this agreement. <br /> <br /> -1- <br /> <br /> <br />
