AGREEMENT REGARDING IMPLEMENTATION OF NONPOINT SOURCE CONTROL EVALUATION PROGRAM Alameda County Flood Control and Water Conservation District, a local public agency of the State of California: City of Alameda, a municipality of the State of California; City of Albany, a municipality of the State of California; City of Berkeley, a municipality of the State of California; City of Dublin, a municipality of the State of California; City of Livermore, a municipality of the State of California; City of Piedmont, a municipality of the State of California; City of Pleasanton, a municipality of the State of California; AGREE this day of , I988, as follows: RECITALS: A. The San Francisco Bay Regional Water Quality Control Board, having accepted a nonpoint source control evaluation plan from Alameda County, requires that local agencies in the County of Alameda, including the parties to this agreement, shall implement and complete the evaluation plan by June 30, lggl. B. This agreement will provide for the allocation of responsibility for the work and for distribution of the costs allocated to the seven cities not in an Alameda County Flood Control Zone where benefit assessment fees are paid. AGREEMENT~ 1. In accordance with the Water Quality Control Plan for the San Francisco Bay Basin (Basin Plan), the Alameda Count~ Flood Control and Water Conservation District {hereinafter District is assuming a sig- nificant coordination role in the implementation of this program and shall undertake to secure the services of a consultant in accordance with District procedures on selection of professional consultants. The District's contract with the consultant will contain a hold harmless and indemnity provision for the benefit of all parties to this agreement. -1-
