In response to an inquiry by Commissioner Fox regazding whether he objected to <br />Condition No. 6 containing the wording "the pazent/guazdian is remaining on-site" in the <br />letter from the Department of Social Services, Mr. Balch replied that "guazdian" had a <br />legal connotation that they could not enforce and suggested the phrase "parent or <br />chaperone." He noted that their staff would not be directly supervising the children. <br />Ms. Decker noted that the first sentence of Condition No. 6 would be removed, leaving <br />the condition: "The applicant is required to obtain written approval from State <br />Department of Social Service Community Caze licensing prior to implementing any <br />activities that may allow children being dropped off at the facility." Conditions would be <br />added that would address the concerns: "Children shall be checked into the facility, and <br />unsupervised dropoffs would not be permitted" Also, "Unsupervised children shall not <br />be permitted within the facility. A designated adult, not including staff or members <br />affiliated to SuperFranks, shall be with the child or group of children engaged in the <br />activities of the facility." Also, "Changes in operations will need to have a modification <br />to the conditional use permit unless otherwise determined by the Planning Director." She <br />noted the changes regazding Condition No. 4 related to "party patrons" rather than "party <br />guests," and one pazking space for every two patrons is acceptable to staff. Language <br />regazding "walk-ins, sports teams, and off-peak uses" would also be clarified for that <br />condition. <br />Vanessa Kawaihu, 871 Sycamore Road, was glad that the pazking conditions had been <br />clazified. She encouraged the Commission to approve this project and believed it would <br />~^ be an enhancement to the City's indoor recreation options. <br />THE PUBLIC HEARING WAS CLOSED. <br />Commissioner Roberts moved to make the required conditional use findings as <br />listed in the staff report and to approve Case PCUP-161, subject to the conditions <br />listed in Exhibit B of the staff repots, as recommended by staff, with the following <br />modifications: <br />1. Condition No. 4 is amended as follows: <br />"The operator of the facility shall use the following parking ratio in <br />determining the maximum occupancy capacity within the facility so that <br />the demand for parking would not exceed the 128 parking space available <br />on site: <br />Private 6aest Party Patron: One parking space for every guest <br />two patrons <br />Walk-ins, snorts teams. <br />and off-weak uses: One parking space for every four <br />patrons <br />"If parking from operation of the facility becomes an issue, the applicants <br />shall be required to mitigate seise arkin impacts as determined by the <br />Planning Director.
