Ms. Decker <br />replied that staff has been working on a Code amendment to remove the requirement for <br />a conditional use permit for these uses as well as others. A workshop to review those <br />changes would take place, as would outreach to the Chamber of Commerce and other <br />business organizations. <br />d. PUD-80-08-1M/PCUP-161, Sherman Balch/SuperFranks <br />Applications for a minor modification to an existing Planned Unit Development <br />(PUD-80-06, Schoebers Racquetball) and for a conditional use permit to operate <br />an indoor recreational facility in an existing building located at 5341 Owens <br />Court. Zoning for the property is PUD-C (Planned Unit Development - <br />Commercial) District. <br />t~ <br />Ms. Decker summarized the staff report and detailed the background and layout of this <br />project. She noted that the applicant would perform alot-line adjustment, and the <br />parking areas would be opened up to provide better circulation. Traffic circulation and <br />parking between the site would also be enhanced. She noted that the applicant provided <br />staff with an overall business operations plan that would mitigate the pazking concerns. <br />The conditions placed on the project mitigate pazking and site circulation concerns. <br />There was concern that childcaze licensing may need to be provided. The applicant <br />provided a letter from the State indicating that the current proposal would not require any <br />State licensing. Staff included a condition that was intended to allay concerns that if <br />there were any changes to the existing operations and if children were dropped off <br />unsupervised, the appropriate State licensing must be obtained. Staff supported this <br />application and recommended that the required findings be made and the proposed family <br />entertainment center be permitted at the subject location. <br />In response to an inquiry by Commission Peazce regazding whether the language <br />requiring that applicant's requirement to "mitigate noise impacts if pazking became an <br />issue," refers instead to "pazkine impacts," Ms. Decker said yes. <br />In response to an inquiry by Commissioner Fox regarding whether the language "no <br />dropoff of children shall be allowed at any time" should be reworded to include "without <br />parents or adult supervisors remaining on-site," Ms. Decker confirmed that was the <br />~ intent. <br />PLANNING COMMISSION MINUTES Mazch 29, 2006 Page 13 of 25 <br />
