Make the Tentative Tract Map findings regarding the acceptability or suitability <br />of the project as described in Findings 1-9 in the staff report; and <br />3. Approve Tentative Tract Map 7534. <br />Ms. Decker advised that revised conditions of approval were distributed to the <br />Commission in two forms: the draft conditions of approval and a redlined memo of the <br />changed conditions. Staff met with Mr. Jansen, the applicant, and he was amenable to <br />the changes. <br />In response to an inquiry by Commissioner Roberts regarding when the front lot was <br />changed to two rentals by the Council, Ms. Decker replied that the inclusion of the <br />paragraph was an error and should be deleted. <br />In response to an inquiry by Commissioner Roberts regazding the Tentative Tract Map <br />findings on page 5, Ms. Decker confirmed that was a new entry. <br />In response to an inquiry by Commissioner Fox regarding whether the sidewalk on <br />Street A would be flush with the street or whether there would be a buffer, Ms. Decker <br />confirmed that it would be a sepazated sidewalk with a parkway on the north side and <br />vegetated Swale on the south side between the curb and the sidewalk. <br />!'~ In response to Commissioner Fox's inquiry regazding the maintenance of the sidewalk, if <br />that sidewalk were located outside the right-of--way, Mr. Roush confirmed that the <br />sidewalk would be maintained by the homeowners association and added that the <br />property owner would enter into a maintenance agreement with the City prior to the <br />recording of the Final Map. <br />In response to an inquiry by Chairperson Arkin regarding whether Zone 7 and the arroyo <br />slope had been discussed at the public hearing for the PUD and whether the homeowners <br />association would be responsible for the maintenance of the arroyo, Ms. Decker <br />confirmed that it was discussed at both the Planning Commission and City Council <br />heazings. Staff clazified that in regazd to Zone 7 and the actual responsibilitiestbat were <br />anticipated for the maintenance of the arroyo, it was unknown if those responsibilities <br />would be accepted by Zone 7 or by the homeowners association. The City and the <br />applicant have been in continued discussions with Zone 7, determining that the <br />development standards for Zone 7 require a 2.5:1 slope. The City has asked the applicant <br />to provide an open offer of dedication to Zone 7 in support of Zone 7's mission <br />statement, and if ownership were accepted, maintenance would likely be a part of the <br />dedication. If Zone 7 chooses not to take ownership, the homeowners association would <br />own the lands and maintain them, similar to the Nolan Farms project. <br />THE PUBLIC HEARING WAS OPENED. <br /> <br />PLANNING COMMISSION MINUTES February 8, 2006 Page 3 of 18 <br />
