54. The developer acknowledges that the City of Pleasanton does not guarantee the <br />availability of sufficient sewer capacity to serve this development by the approval <br />of this case, and that the developer agrees and acknowledges that building permit <br />approval may be withheld if sewer capacity is found by the City not to be <br />available. <br />55. This approval does not guarantee the availability of sufficient water to serve the <br />project. The City shall withhold building permits for the project if at the time <br />building permits are applied for, mandatory water rationing is in effect, unless the <br />City has adopted a water offset program and unless the developer is participating <br />in the program. Notwithstanding the developer's participation in such a program, <br />the City may withhold building permits if the City determines that sufficient water <br />is not available at the time of application of building permits. <br />56. The office building shall be designed and constructed to maintain an interior noise <br />level of 45 dBA Ley. Information sufficient to determine that this noise level can <br />be met shall be submitted with the plans submitted for issuance of building <br />permits and shall be subject to review and approval by the Planning Director and <br />Chief Building Official prior to issuance of building permits. <br />GREEN BUILDING <br />57. The subject building shall achieve at least a LEED "Certified" level on the <br />LEED Green Building Checklist at the time of building permit submittal. A final <br />list of the green building measures shall be submitted in conjunction with the plans <br />submitted for issuance of building permits and shall be subject to the review and <br />approval by the Planning Director prior to issuance of building permits for the <br />project. <br />58. The proposed LEED Green Building Checklist shall be shown on one of the <br />first two pages of the plans submitted for the issuance of a building permit. The <br />sheet number(s) where each checklist item is addressed in the plan set shall be <br />noted on the checklist. All proposed green building measures shall be shown <br />throughout the plan set, as appropriate, as determined by the Planning Director and <br />the Chief Building Official. <br />59. The Building and Safety Division may require special plan check or inspections <br />for the green building measures proposed. If required, the applicant shall provide <br />verification to the Planning Department clearly stating that the Building and <br />Safety Division approved all applicable requirements relating to green building <br />measures. Said verification shall be provided prior to occupancy. <br />10 <br />
