UP-69-2, Shell Oil Comoanv <br />To allow the construction and maintenance and operation of a gasoline <br />automotive service station at 5251 Hopyard Road in a C-F (Commercial <br />Freeway) District. <br />Chairman Antonini opened the Public Hearing. Since approval had been <br />received from the Design Review Board earlier in the evening regarding <br />site plan, architectural and landscaping approval, and the property had <br />been conditioned by that Board, the Planning Director stated that there <br />was nothing he could add to the staff report for the Uae Permit being <br />applied for before the Planning Co®nisaion. <br />Upon motion of Chairman Antonini, seconded by Commissioner Arnold, and <br />carried, the Public Hearing was closed. <br />Upon motion of Commissioner Arnold, seconded by Commissioner Garrigan, and <br />carried, the following resolution was adopted unanimously. <br />RESOLUTION N0. 844 <br />WHEREAS, the application of Shell Oil Company to <br />allow the construction and maintenance and <br />operation of a gasoline automotive service <br />station at 5251 Hopyard Road in a C-F <br />(Commercial Freeway) District, has come before <br />this Commission, <br />NOW, THEREFORE, BE IT RESOLVED, that UP-69-2 be approved, subject to the <br />following condition: <br />1. That the applicant adhere to the conditions <br />of approval as conditioned by the Design Review <br />Board under Z-69-9. <br />c. Z-69-11, D & V Builders, Inc. <br />Under P.U.D. regulations, allow the construction of a 72-unit garden <br />apartment complex in an RM-25 (Multiple) District located at the northeast <br />corner of Black Avenue and Hopyard Road. <br />Chairman Antonini opened the Public Hearing. Mr. Castro stated that this <br />application before the Commission denotes a very preliminary review of the <br />development. Mr. Dudley Frost was present at the meeting and presented <br />another elevation plan. <br />There was a fair amount of discussion between the staff and members of the <br />Coamiisaion. Chairman Antonini inquired after the agreement that had been <br />made regarding compatibility with surrounding areas and quality of design. <br />The Planning Director read three conditions which were part of the original <br />P.U.D. application, which pertained more to quality of design than to <br />compatibility with surrounding areas, although this was a factor too. <br />Mr. Frost then introduced his architect, Mr. Ken Griffin, remarking that <br />a great amount of work and attention to detail was given to these garden <br />apartments, and that he wanted to thank the Planning staff for presenting the <br />pertinent factors in the design development. <br />Upon motion of Chairman Antonini, seconded by Commissioner Garrigan, and <br />carried, the Public Hearing wa,s closed. <br />Upon motion of Commissioner Garrigan, seconded by Commissioner Plato, and <br />carried, the following resolution was unanimously adopted. <br />- 2 - <br />
