Z-69-17. W. Mark Iiovera, dba Allied Brokers <br />Application for a Zoning Permit to allow the operation of a real estate office at <br />525 Main Street, Pleasanton, in a C-C District. <br />Chairman Plato opened the Public Hearing. Mr. Castro explained the staff report, <br />stating that the onlq problm is the establishment of same sort of parking <br />requirement for merchants in the Central Business District. <br />Heretofore, three methods to iaeure participation in the parking district were: <br />1. Present policy. <br />2. Put up cash in lieu of parking. <br />3. Creation of parking assessment <br />districts. <br />The Co®iasionera inquired as to provision in the Zoning Ordinance for this <br />parking district, and when cash is received, where does the money go. A fund <br />would have to be set up for it, how, it is sot known at this time. <br />The Planning staff feels that the beat time to impose a condition regarding the <br />Parking District is when new applications came in. <br />It was the recommendation of Chairman Plato that we sit down with the City Attorney <br />to discuss a definite plan to settle this problm. Commissioner Antonini does not <br />feel that paying one's way out of the parking situation will solve the problm. <br />The onlq possible solution is the assessment district. Again, this is subject <br />to the approval of the population. <br />Mr. Mark Mogers of Allied Brokers ie in complete agrement with a parking district. <br />He feels it would be the moat logical solution. Aa tenants, they are in full <br />accord. He is not willing to put up cash at this tine, has a lease with the land- <br />lord to provide for this parking district when it cameo in. <br />The C~i.eaion feels that they world like to go along with a policy of having the <br />City Attorney work up a feasible method to impose a Parking Metrict requirment <br />on the merchants in the Central Business District. Chairman Plato shares this <br />feeling. Commissioner Antonini feels the Planning Caemiasion should take action and <br />pass it on to City Council. The previous methods of obtaining agrements from the <br />applicants are not legally enforceable, although there nay be a moral obligation. <br />Upon motion of Chairman Plato, seconded by Caamiasioner Carrigan, and carried, <br />the Public Hearing was closed. <br />Upon motion of Co®iasioaer Antonini, seconded by Co®issioner Carrigan, and <br />carried, the following resolution waa adopted unanimously. <br />- 8 - <br />
