Jack Bras for Ralph Lee (Item referred by Board of Adjustment to the <br />arming omm se on <br />Application for a variance to Sec. 2.102c of Zoning Ordinance No. 520 to allow the <br />encroachment of 6 ft. patio fencing 7 ft. into the required front yard of that property <br />described as Parcels 16 and 17, Tract 2805, Unit 5, Norton Way, Pleasanton (Public Hearing <br />continued from June 11, 1969). <br />This item was a carry-over from the Board of Adjustment meeting and was reviewed by the <br />full Commission after the approval of amendments on Article 2, Sec.2.102, which had a direct <br />bearing upon Mr. Lee's application. <br />It was the opinion of the Planning Director that the private patios were set too close to <br />the sidewalk. The variance concerned the 6 ft. high fencing, but Mr. Bras, who represented <br />Mr. Lee at the public hearing, explained that because of the topography of the area, the <br />apartment structure sits on a lower level than the sidewalk, thus from the sidewalk, the <br />fence is only about 4~ ft. high. Considerable discussion ensued. <br />Upon motion of Chairman Garrigan, seconded by Commissioner Pons, and carried, the Public <br />Hearing was closed. <br />Upon motion of Chairman Garrigan, seconded by Commissioner Pone, and carried, the follow- <br />ing resolution was adopted unanimously. <br />BESOLUTION N0. 93B <br />WEIEREAS, the application of J. Jack Bras for Ralph Lee for <br />a variance to Sec. 2.102c of Zoning Ordinance <br />No. 520 to allow the encroachment of 6 ft. patio <br />fencing 7 ft. into the required front yard of <br />that property described as Parcels 16 and 17, <br />Tract 2805, Unit 5, Norton Way, Pleasanton (Public <br />Hearing continued from June 11, 1969). <br />NOW, THEREFORE BE IT RESOLVED, that V-69-14 be approved subject to the <br />following conditions: <br />1. That the permit is granted for the property as <br />described in the application and any attachments <br />thereto and as shown on the attached plan labeled <br />Exhibit A, with the following modifications: <br />a) That Buildings 2 and 3 be placed approximately <br />3 ft. west of its location as noted on Exhibit A, <br />or a total of 11 ft, between the patio fences and <br />the public right-of-way on Northn Way. <br />b) That the last parking space ae shown on the plot <br />plan located north of the patio areas of Building 3 <br />be eliminated. <br />c) That a concrete block or a precast concrete wall <br />be provided for the patio areas of Building 1, <br />with the remainder of said fence to be of redwood <br />aia ter is 1. <br />
