due to the cumulative development of major <br />commercial/industrial projects. Fire apparatus, manpower and <br />other facilities necessary shall be those identified as <br />required to maintain existing levels of fire service (defined <br />as the level in existence as of the date of this Agreement) <br />in the above-mentioned studies and as deemed necessary by the <br />City Manager. Owners agree to participate in the funding of <br />such apparatus, manpower and other facilities in whichever <br />manner best achieves the maintenance of existing levels of <br />fire service through timely additions of fire safety <br />equipment, facilities and personnel, as determined by City. <br />In determining the level of participation of such funding <br />agreed to herein, City shall take into consideration the <br />contributions towards fire services made by the project site <br />(and projects developed on it) in its ordinary contribution <br />towards funding city services generally, including, but not <br />limited to, room taxes, sales taxes, property taxes, etc., <br />and the level of fire protection designed into projects <br />developed on the subject property. <br /> <br />IV. OWNERS' RIGHTS <br /> <br /> With reference to each of the agreements contained <br /> <br />herein to place subject site into one or more assessment <br />districts, benefit districts, or other district or funding <br />mechanism requiring approval of all or a majority of <br />properties so included, Owners shall either (1) not protest <br />the establishment of the district or (2) affirmatively vote <br />for the creation of the district or other mechanism, <br /> <br /> -4- <br /> <br /> <br />
