reason in not granting this application, and on motion of Commissioner Landon, seconded <br />by Commissioner Lozano, and approved by all Commissioners present, RESOLUTION N0. 94, <br />approving the CONDITIONAL ZONING PERMIT under the following conditions, was passed: <br />RESOLUTION N0. 94 <br />Granting Conditional Zoning Permit on Application of Pleasanton Heights Swim Club, <br />Inc., 419 Bonita Avenue, Pleasanton, California, Piled February 29, 1960, for com- <br />mercial use. <br />The above described application, having been duly considered, pursuant to <br />Ordinance No. 293, of the City of Pleasanton, and good cause appearing; <br />NOW THEREFORE, the Planning Commission does hereby resolve as follows: <br />1) That no public hearing is deemed necessary in the public interest in <br />this matter. <br />2) That the Planning Commission finds the conditions of Section 2.22 of <br />Ordinance No. 293 pertaining to commercial uses have been met. <br />3) That a CONDITIONAL ZONING PERMIT is hereby granted for a period of six <br />(6) months, effective this date, subject to the following conditions: <br />a) To insure the use of the land as a neighborhood community pool, <br /> restrictions are made as follows: <br /> 1) Residents of the City of Pleasanton only may be members. <br /> 2) A minimum of 2~3 of the membership shall reside within 2000 <br /> feet of the site. <br /> 3) Membership shall not exceed 120 families. <br /> 4) Guests shall be limited to 25 per member per year, with no <br /> admission to the public for money consideration. <br /> 5) No alcholic beverage or food concessions allowed on the <br /> premises. <br />b) To prevent traffic hazards in a residential community, one off- <br /> street parking place, properly paved, shall be provided for every <br /> six member families. <br />c) Lot coverage shall be as follows: <br /> 1) Front yards shall be at least 20' with a minimum of 5' on <br /> either side, a total of 12' on both side yards, and a 30' <br /> rear yard. <br /> 2) Yards shall be landscaped in keeping with nearby residences. <br /> 3) A six foot solid fence with two foot barbed wire on top shall <br /> surround entire area. <br />d) To provide for safety of the public using the swimming pool, the <br /> fol lowing regulations are recommended and imposed: <br /> 1) Hours of operation shall be 10 A.M. to 9 P.M. with a lifeguard <br /> on duty at all times. <br /> 2) When not open, the gate shall be closed and locked with keys <br /> in the possession of members only. <br />e) A general enforcement provisions are as follows: <br /> 1) Construction will be by a licensed contractor with final in- <br /> spection by the City Engineer. <br /> 2) Upon wirtten complaint for breach of conditions, the Planning <br /> Commission may after hearing and finding a material breach of <br /> conditions, revoke this Conditional Zoning Permit. <br />4) That the Secretary is hereby instructed to forward copies of this Resolution <br />to the applicant, city officers and any other interested parties. <br />A discussion followed regarding the annexing of certain land.
