1. The Planning Commission does find as follows:
<br />a. Notice has been gives as required by law.
<br />b. Tha circumatancea required by Section 19.1003 of Ord. No. 309, as
<br />amended, do exist.
<br />2, A Conditional Uae Permit is hereby granted with the following conditions
<br />attached thereto:
<br />a. The entrance to the subject location from Spring Street via as
<br />easement moat be assured.
<br />b. No obstruction of Spring Street or the required access alley will be
<br />allowed.
<br />c. Existing on-street parking on Spring Street must be protected,
<br />d. Perfosmanca Standards, ea specified in Section 17.100 et seq. of
<br />Ord. No. 309, mist be met.
<br />e. Applicable provisions of the Building, Plumbing and Electrical
<br />Codes of the City moat be met.
<br />3. A copy of this Resolution shall be sent to lntereatad parties.
<br />Secretary Falea neat introduced the request of Mr. Jay D. Lambert, 2357 Strowbridgs
<br />Ave., Castro Valley, for rezoning of a parcel of property lying north of Angela
<br />Street, south of Roae Avenue and east of the Western Pacific Railroad right-of-way;
<br />and a parcel of property lying north of Rose Avenue, south of Division Street, and
<br />east of the Western Pacific Railroad right-of-way, from an R•1 (single-family
<br />residential) District to an RG-25 (residential garden apartment) District. This
<br />is part of the area to be studied for rezoning to be put on the agenda for the
<br />meeting of July 19. Mr. Lambert and Mr, Chris Beratlis, representing him, were
<br />present in the audience, On recommendation of Chairman Lozano, it wen agreeable
<br />to Nr. Lambert to continue this request to the July 19 meeting.
<br />The nest item on the agenda was further consideration of Planning Commission Reso-
<br />lution No. 175, granting a variance from Section 6.5, Ord. No. 309, to Mr, Forrest
<br />A. Adams, 479 Adams Court, in order to construct three single-family dwellit~a on
<br />Adams Court in an R-1 (single-family residential) District. Mr. False stated the
<br />plot plan submitted by Mr. Adams showed the property extending 13 ft. into what
<br />would be the street--the 55.63 minimim lot width granted would actually be 54.53
<br />ft. frontage, which is 1.1 ft, less than Resolution No. 175 specifies. On the
<br />balls of Resolution No. 175, as adopted bq the Commission granting this variance,
<br />the City Engineer has been instructed not to issue building permits for this area,
<br />which does not have a frontage of 55.63 feet, unless the Resolution is amended,
<br />Mr. Adams was present in the audience. After considerable discussion by the members
<br />of the Commission and Mr, Adams, it was decided Mr, Adams would change the delinea-
<br />tion of his plot plan to 54.53 feet frontage, initial it, and resubmit it to the
<br />Commission. Mr. Adams retired from the meeting to amend his plot plan, and the
<br />matter was passed to the end of the agenda.
<br />The next item on the agenda was a request from Blaze Neon, 37815 Niles Blvd.,
<br />Fremont, for a Zoning Permit to allow construction of afree-standing sign for
<br />The Ivory Fine Foods, Pleasant Plaza Shopping Center, Mr. Ken Randall, representing
<br />Blaze Neon, was present in the audience. Mr. Falea stated the Commi.esion had in-
<br />dicated at the meeting of June 21 that they had no objection to the two small signs
<br />against the building. P1r. Randall has applied for Zoning Permits for these two
<br />signs. The staff inspected the area, and both signs were in accordance wltls the
<br />Zoning Ordinance. Mr, Randall hoe now submitted a revised drawing for a free-
<br />standing sign which is smaller than that originally submitted (see plan on file).
<br />City Engineer Sypher was asked for his opinion with regard to obstructions to
<br />traffic, and he said the only question would be one of seathetica; there would be
<br />no critical obstruction to traffic. It was .moved by Commissioner Antonini, seconded
<br />by Commissioner 4Tipfli, and carried, that the request of Blaze Neoa for a Zoning
<br />Permit to allow construction of a free-standing sign for The Ivory Fiae Foods,
<br />Pleasant Plaza Shopping Center, be approved according to plan submitted under data
<br />of June 29, 1962, subject to payment of all fees.
