Mr, Stanley is now Aubmitting a drawing in con- <br />formance with Stipulation No. 3; "A landscaping plan untiet be submitted and approved <br />by the Planning Commission," Mr, Stanley was present in the audience end presented <br />a landscape plan, and state a continuous row of evergreen trees is to be planted <br />on the west side of the subject property. It was moved by Vice-Chairman Landon, <br />seconded by Commissioner Rega, and carried, that the landscape plan presented by <br />Mr. John M. SL•an].ey for the subject property, for which a Zoning Permit was granted <br />as per Resolution No. 182, be approved as submitted provided the trees designated <br />to be planted on the west side are evergreen. <br />Under Communications, Secretary Falea reminded the Commission of an invitation ex- <br />tended to the members by the Eastbay Division, League of California Cities, to a <br />dinner meeting at Castlewood Country Club on November 9. <br />Secretary Fales reported he has been unable to get more information from the Alameda <br />County Planning Department with regard to an application submitted to them from <br />C.A, Harris, 527 Happy Valley Road, fox zoning approval ea a legal building site <br />for two homes a parcel of land in an A-2 District reduced in area and reduced in <br />average width, which matter has been held over from the meeting of October 18. Dis- <br />cussion ensued on the difficulty the Pleasanton Planning Commission has been encoun- <br />tering in making recommendations on referrals from the County Planning Department <br />due to meager information belag conveyed. Vice-Chairman Landon suggested writing <br />the County Planning Department and informing them the Pleasanton Planning Commission <br />is unable to make a recommendation one way or another in this case because of lack <br />of sufficient information. It was moved by Vice-Chairman Landon, seconded by Cam- <br />miasioner Rega, and carried, that a memorandum be written to the County Planning <br />Commission containing the requirements of the Pleasanton Planning Commission for <br />building sites as being on dedicated, approved and improved rights-of-way, and that <br />the City has experienced several cases that have been problem areas due to the fact <br />thAt the City d1d not act properly soon enough. <br />Under Platters .for the Information of the Commission, City Attorney Struthers <br />delivered a message Erom the City Council admonishing the Commission to be careful <br />in granting Variances which may set a precedent which would be detrimental to the <br />City, Diacussioa followed relating to the imposition of penalties for construction <br />started in violation of the Building Code and without making application fox <br />Variances. City Attorney Struthers stated thaC, in practice, there is no automatic <br />relationship between an untimely application and the work the staff has to do. It <br />is not a service charge, but a penalty, and then it involves court and criminal <br />procedures--whereas these are actually misdemeanors. A discussion was iritieted by <br />Commissioner Rega regarding reasons for granting a Variance. Mr. Ted Fairfield <br />remarked it is usually not contractors who begin construction without required <br />Variances, but "do-it-yourself" people. Vice-Chairmen Landon stated if the Council <br />desires to discuss the matter further, the Commission will welcome the opportunity, <br />There mcy be ways in which gradual changes in the existing Ordinance may be made. <br />There being no further business, on motion of Vice-Chairman Landon, seconded by <br />Commissioner Wipfli, and carried, the meeting was adjourned at 10:07 P. Pl. to meet <br />again on Thursday, November 15, 196?., at 8:00 P. M. <br />
