M I N U T 8 S <br />of <br />THE MEETING <br />of <br />THE PLANNING COMMLSSION <br />Pleasanton, California <br />April 4, 1963 <br />T-,e regularly scheduled meadpg of the Planning Commission was called to order <br />at 8;00 P.M. oa Thursday, April 4, 1963, by Vice+Chairman Frank Lozano, <br />ROLL CALL showed the following: <br />Present? Vica-Chairman Lozano <br />Commissioners Antonini <br />Wipfli <br />Secretary Falea <br />Ex-Officio Hohn <br />Absent: Chairman Landon <br />Commissioner Rega <br />Ex-Officio Kamp <br />On motion of Commissioner Antonini, seconded by Commissioner Wipfli, the minutes <br />of the meeting of March 21 were unanimously approved as presented by those Com- <br />ffiasionera present. <br />Vice-Chairmen Lozano then proceeded to open the public hearing on the application <br />of Mr. Dante Manfredinl, 4563 Augustine Street, for a Variance from Section 6.5 <br />(aide and rear yard requirements), Ord, No. 309, in order to construct a rear <br />dwelling under Section 16.500, Ord. No. 309, at the above address, in an R-1 <br />District, Mr. Manfredini was present in the audience. Mr. Falea explained that <br />a two+foot aide yard and a twelve-foot rear yard Variance ie required, ae Mr. <br />Manfredini wishes to remodel a building erected approximately 35 gears ago, there- <br />by changing the utilization of the property. This has been a non-conforming use, <br />and Mr. Manfredfni now wishes to make it a conforming use. There being no com- <br />ments from the audience, Vice-Chairman Lozano declared the public hearing closed. <br />Mr. Fales was called upon for the staff report and prefaced his remarlca by quoting <br />from Section 16.500, Ord. No. 309. He stated further that the purpose of the <br />remodeling ie to provide a living unit fora relative of Mr. Manfredini~a family. <br />He said the staff recommends the Variance be granted with the condition that if, <br />in the future, this rear dwelling ie converted to use other than to house a blood <br />relative, full conformity with the Zoning Ordinance will have to be undertaken. <br />This would mean that the unit could not be rented out in the future without con• <br />fortuity with the Zoning Ordinance. After discussion by the Commission, open <br />motion of Commissioner Antonini, seconded by Commissioner Wipfli, Che following <br />resolution was unanimously adopted by those Commissioners present: <br />RESOLUTION N0, 209 <br />WHEREAS, application made by Mr. Dante Manfredini, 4563 Augustine Street, <br />for a Variance from Section 6.5 (side and rear yard requirements), <br />Ord. No. 309, in order to construct a rear d*.oelling under Section 16,500, <br />Ord. No. 309, at the above address, 1n an R-1 District, has come before <br />this Commission; <br />NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS: <br />1. The Variance is hereby granted subject to the following <br />conditioa: <br />a. The occupancy of said unit shall be non•com~rcial, <br />and shall be liffited to persona so related and sup- <br />ported by the owner of said pzopertq ao ae to qualify <br />na a depandeat for Federal income tax purposes. <br />
