Mr. Falea recommended the Commission make a decision on the basis of the
<br />City Engineers report. There has been no recommendation in writing from
<br />the School District. Mr. Fairfield wondered what the logical time allowed
<br />the School District should be in order to make a decision. Mr, Fairfield
<br />also asked that the outline of Exhibit "A" be changed slightly unless the
<br />entire map is to be acted upon. Chairman Landon asked that the Commission
<br />take a vote on whether or not they will consider the entire Tentative Map
<br />or that portion outlined in green. Mr, Falea said his recommendation
<br />remains the same because it is incumbent upon the City to give the School
<br />District the benefit of the doubt. If a second Tentative Map is submitted
<br />under the 40-day limitation, then the school actuation would have to be
<br />decided, Mr, Falea then requested Chairman Landon to declare a recess in
<br />the meeting, in order that he might confer by telephone with Dr, Haskell
<br />to learn of any later developments as a result of the School District
<br />meeting of May 1, Chairman Landon declared a recess at 9:25 P,M, Coamis-
<br />aioner Rega absented himself at this time. ~'
<br />Chairman Landon reconvened the meeting at 9:38 P.M. Mr. False stated he
<br />had learned the School Board has not taken formal action, and in fact did
<br />not meet. The Board did hold a study session, and Dr. Haskell expressed
<br />the thinking of the Board which he understood was to reduce the area of
<br />the approved map in order to allow time for a decision to be made regard-
<br />ing selection of a school site,
<br />Mr, William Jacobson said that the study session of April 25, Dr. Haskell
<br />made some statements which Mr, Jacobson was willing to accept. Mr, Jacob-
<br />son said a reduced tentative map could be worked out, but it is not fair
<br />to a developer not to have some accurate commitment from the School Board,
<br />He can see no objection to the submission of the entire tentative map.
<br />He would not file a final map beyond the green line fora year or two. He
<br />will not file the final map until the school situation is settled--whether
<br />parochial or elementary, Mr. Falea said a condition of approval could be
<br />that the tract not be developed outside of the green line until the school
<br />situation is settled, City Attorney Struthers said if the tentative map
<br />is approved, then the final map can be filed, There should not be a
<br />tentative map where there cannot be a final map filed. The tentative map
<br />can be approved, disapproved or conditionally approved by the Planning
<br />Commission. Mr. Falea said the City assumes an obligation to act for other
<br />organizations, namely, in this instance, the School District. This puts
<br />the City in a difficult position because the School District has not
<br />worked under this Ordinance before. Mr. Falea recommended that since the
<br />School District did not make a decision in the time required by law, the
<br />green line be adopted as the tentative map. Then a second tentative map
<br />can be filed and this will give the School District a second chance, In
<br />this instance, 40 days is not too much to be delayed. Mr. Jacobson said
<br />he would agree to the City Administrator's suggestion, Mr, Falea said he
<br />had explained to the Superintendent of Schools that the developer is
<br />entitled to a decision. Mr. Fairfield asked: (1) That the filing fees be
<br />waived for the balance of the property not approved on the map for Tract
<br />No, 2473; (2) Could he resubmit the same map showing this as approved and
<br />attached to Tract No, 2473. (3) He wishes to modify the original tract
<br />slightly. The City Engineer recommended modification to the green line
<br />as indicated on the revised approved map, Mr, Jacobson said he will co-
<br />operate in every way possible. Chairman Landon thanked the developer for
<br />hie patience throughout this problem,
<br />Upon motion by Commissioner Wipfli, seconded by Commissioner Lozano, the following
<br />resolution was unanimously adopted by those Commissioners present:

<br />The Tentative Subdivision Map for Tract No, 2473, ae codified, having
<br />come before this Commission as provided by Ordinance No. 358, is
<br />hereby approved, with the following modifications and conditions:
<br />1. Modifications to Ordinance Noy 358 as vrovided by Article 9
<br />a, Modified Section 7.14(8) in order to allow a lot depth in
<br />excess of three times the width on the north aide of Mission
<br />Drive,
<br />b, Modified Section 7,04 in order to allow the property line
<br />radius on cul-de-sacs to be 90 feet rather than 100 feet
<br />in order to fit the street cross-section.
