RESOLUTION N0. 229 <br />WHEREAS, the application of 1d.A, Eaton and A.H. Johnson, 1780 "A" Street, <br />Hayward, for an amendment to Ord, No, 309 rezoning a parcel of <br />approximately one acre, located on the northeast corner of Santa Rita <br />Road and Nevis Street, from R-1 to RG-15 has come before this Commission; <br />NOW, THEREFORE, BE IT <br />RESOLVID, that the above-named application for rezoning be denied primarily <br />due to the fact that it is foreign to a policy of the City with <br />regard to spot zoning, and because it ie not compatible with the surrounding <br />area. <br />The public hearing was then opened by Chairman Landon on the application of C, <br />Beratlis, 550 Main Street, for a Variance from Section 8.5, Ord. No. 309, in order <br />to allow construction of multiple dwelling units with a reduced front-yard setback, <br />on a vacant lot located between 4779 and 4857 Harrison Street, in an RG-15 District. <br />Mr. Emil Sanger, the prospective builder, was present in the audience and displayed <br />his plans before the Commission, including the requested 5-ft, reduction in the <br />front-yard setback, There beisy; no further comments from the audience, Chairman <br />Landon closed the public hearing. Mr. Falea, in giving the staff report, recommend- <br />ed granting of the Variance and stated thereby the prapoaed structures would be <br />situated five feet farther from the railroad right-of-way, which would be desirable. <br />Upon motion of Commissioner Wipfli, seconded by Commissioner Antonini, the follow- <br />ing resolution was unanimously adopted by those Commissioners present: <br />RESOLUTION NO. 230 <br />WHEREAS, the application of C, Beratlis, 550 Piain Street, for a Variance <br />from Section 8,5, Ord, No, 309, in order to allow construction <br />of multiple dwelling units with a reduced front-yard setback, on a vacant <br />lot located betvreen 4779 and 4857 Harrison Street, in an RG-15 District, <br />has come before this Coasni.saion; <br />N04I, THEREFORE, BE IT RESOLVED AS FOLLOWS: <br />1. Mr. C, Beratlis is hereby granted a Variance for con- <br />struction as proposed in said application. <br />Under Communications, Secretary Tales read a letter from Ted Fairfield proposing a <br />street name change in Tract 2473: the substitution of Junipero Drive for Capistrano <br />Drive, It was moved by Commissioner Wipfli, seconded by Commissioner Rega, and <br />carried, that the staff be instructed to require the final map of Tract No. 2473 <br />t~ read Juninero Drive, instead of Capistrano Drive as approved on the Tentative <br />Map. <br />Mr. Tales asked to be excused at this point in the meeting. <br />Chairman Landon then proceeded to the application of D, Deni, 403 St. Mary Street, <br />for a Zoning Permit in order to re~rcate an existing sign at 563 Main St, to 30 <br />West Neal Street, LTpon mo*ion of Comtissioner Antonini, seconded by Commissioner <br />Wipfli, the i-ollcndng resolution wa,^, unanimously adopted by those Commissioners <br />present: <br />RE~Ci,T)TI~N N0,_7,.',1. <br />WHEREAS, the appli,..ei9.on of Mr, D.
