<br />The regularly scheduled meeting of the Planning Commission was called to order at
<br />8:00 P,M, on Wednesday, December 11, 1963, by Chairman Philip Landon.
<br />ROLL CALL showed the following:

<br />On motion of Commissioner Lozano, seconded by Commissioner Antonini, the minutes of
<br />the meeting of November 27, 1963, were approved ae presented by unanimous vote of
<br />those Commissioners present.
<br />The neat item on the agenda was the application of G1. J. Jacobson, 20880 Redwood Road,
<br />Castro Valley, for a Variance from Section 18.601-1, Ord. No. 309, in order to
<br />extend an architectural detail roof overhang into the front yard setback in excess
<br />of the 2~ foot allowable distance, to a distance of 11 feet, fora duplex structure
<br />located at 221 Junipero Drive, in an R-2 District. Mr, Falea stated a telephone
<br />communication had been received requesting that the public hearing on Chia applica-
<br />tion be continued to the next regular Planning Commission meeting. It was moved by
<br />Commissioner Antonini, seconded by Commissioner Lozano, and carried, that the public
<br />hearing on the above-mentioned Variance application of W,J. Jacobson be continued to
<br />the meeting of January 8, 1964.
<br />Chairmmn Landon then opened the public hearing on the application of James P. and
<br />Helen N. Georgia, 640 Division Street, for an amendment to Ord, No. 309 rezoning the
<br />property located at 4546 and 4558 Second Street, from R-1 to RG-15. Mr. Georgia was
<br />present in the audience. There being ao comments from the audience, it was moved by
<br />Commi.aeioner Rega, seconded by Commissioner Lozano, and carried, that the public
<br />hearing be closed. Mr. False, in giving the staff report, stated he had received a
<br />report from Livingston and Blayney, City and Regional Planners, dated December 6,
<br />1963, recommending that rezoning be denied because of possible conflict with the
<br />pending planning program, and because it would be inconsistent with the present
<br />General Plan, would be inharmanioua with present development in the area, and would
<br />constitute a spot zoning. Commissioner Antonini expressed the opinion that the sub-
<br />ject area would be a good Location for residential garden apartments, but he would
<br />prefer having the entire block rezoned to RG-15. After discussion by the Commission,
<br />upon motion of Commissioner Rega, seconded by Commissioner Lozano, the following
<br />resolution was adopted by the following vote; Ayea; Commissioners Lozano, Rega and
<br />Chairman Landon; Noea: Commissioner Antonini; Absent: Commissioner Wipfli.

<br />WHEREAS, the application of James P. and Helen N. Georgia, 640 Division
<br />Street, for an amendment to Ord, No. 309 rezoning the property
<br />located at 4546 and 4558 Second Street, from R-1 to RG-15 has come before
<br />this Commission;
<br />NOW, THEREFORE, BE IT
<br />RESOLVED, that the Planning Commission hereby denies the above-named applica-
<br />tion for rezoning because it is inconsistent with the present
<br />General Plan, and because of recommendation by Livingston and BLayney, City
<br />and Regional Planners, that rezoning of the subject property would be in-
<br />harmonious with present development in the area and would constitute spot
<br />zoning.
