<br />The regularly scheduled meeting of the Planning Commission was called to order at
<br />8:00 P,M. on Wednesday, January 8, 1964, by Chairman Philip Landon.
<br />ROLL CALL showed the following:

<br />City Engineer Campbell acted ae Secretary Pro Tem.
<br />On motion of Commissioner Lozano, seconded by Commissioner Antonini, the minutes of
<br />Che meeting of December 11, 1963, were approved sa presented by unanimous vote of
<br />those Commissioners present.
<br />Chairman Landon opened the public hearing on the application of W.J. Jacobson, 20880
<br />Redwood Road, Castro Valley, for a Variance from Section 18.601-1, Ord, No. 309, in
<br />order to extend an architectural detail roof overhang into the front yard setback
<br />in excess of the 2~ foot allowable distance, to a distance of 11 feet, for a duplex
<br />structure located at 221 Junipexo Drive, in an R-2 District. Mr. William Jacobson,
<br />of Homerite Construction Co., was present in the audience, ae was Mr. Lloyd Donohue,
<br />who explained that the roof overhang in question has already been completed, not in
<br />an arbitrary manner, but in the Hormel course of construction, and could be removed
<br />within 24 hours if the Variance were not approved, The construction in no way
<br />hinders public safety. The setback from the sideyard to the building is 15 ft.
<br />There is a distance of 4 ft. from the sidewalk to the edge of the roof overhang. Mr.
<br />Donohue presented photographs of the construction to the Commission for their ob-
<br />eervation. There being no further comments from the audience, it was moved by Com-
<br />missioner Antonini, seconded by Commissioner t+lipfli, and carried, that the public
<br />hearing be closed. Mr. Campbell, in giving the staff report, read from Section
<br />18.601-1 of Ord,No. 309, and stated Chere is no traffic hazard involved at this time,
<br />and the Commission would Hoc be setting a precedent because future overhangs may be
<br />of a different type. Chairman Landon inquired if the Commission would be obligated
<br />if another application for exactly the same type of overhang were made. City At-
<br />torney Struthers replied that the Commission would be obligated to some extent--each
<br />act Cende to set a policy--but a policy may be changed and the Commission ie not
<br />bound--these are mettera of discretion. Mr. Struthers said, in addition, that he
<br />would prefer to consider the subject application ae a front or sideyard Variance
<br />from Section 7.500. Mr. Campbell stated that the Commission could always deny exact-
<br />ly the same kind of construction in the future if there are too many in a given area;
<br />the number may be controlled. After discussion bq the Commission, upon motion of
<br />Commissioner Lozano, seconded by Commissioner Antonini, the following resolution was
<br />unanimously adopted by those Commissioners present:

<br />WHEREAS, the application of W.J. Jacobson, 20880 Redwood Road, Castro
<br />Valley, for a Variance from Sections 7.500 and 18.601-1,
<br />Ordinance No. 309, in order to extend as architectural detail roof
<br />overhang into the front yard setback in excess of the 2~ foot allowable
<br />distance, to a distance of 11 feet, for a duplex structure located at
<br />211 Junipero Drive, in an R-2 District, has come before this Commission;
<br />NOW, THEREFORE, BB IT
<br />RESOLVED, that the above-named Variance ie hereby granted.
