1
Lozano, and carried, that the public hearing be closed, After discussion by the
Commission, a consensus indicated the desire to await the outcome of the pending
litigation, and upon motion of Commissioner Antonini, seconded by Commissioner
Lozano, the follo•~aing resolution was adopted by unanlnoua vote:
RESOLUTION N0. 415
WHEREAS, the application of Devmar, Inc „ 268 Grand Avenue, Oakland, for
an amendment to Oxd, No, 309 rezoning approximately 6'~ acres at
the southeast corner of Santa Rita Road and the private road owned by the
Kaiser Company, from the R-1 District to the C-N, RG-15 and R-2 Districts,
has come before this Commission;
NOW, THEREFORE, BE IT RESOLVED, that the above-named application for re-
zoning be denied,
Chairman Landon opened the public hearing on the application of the Planning Com-
mission for an amendment to the Pleasanton General Plan assigning a land use
designation to the area between Vineyard and Kottinger Avenues, east of First St.,
now designated '$eld For Further Consideration" on said General Plan. Mr. Fales,
in giving the staff report, said that the City Attorney indicated that amendment
to the General Plan moat take place before any applications for rezoning of the
subject area may be entertained. Mr. Falea read a letter from Mr. James Trimingham,
President of the Pleasanton Area Chamber of Commerce, dated April 14, 1965, expreea-
ing the view that a service station should be at First & Vineyard, with the remainder
professional offices and multiple residential uses. Mr. Blayney said he believes
the east Bide of First St. should be multi-family residential, and that First St.
should be the boundary of the commercial area. He added that a service stallion
is disadvantageous to adjoining property for residential use, and that five of the
a even parcels on the east aide of First St. are too small for commercial use. He
said it takes $400,000 annual business to operate a service station in a city. The
1970 population of Pleasanton is estimated to be 22,000, which would support seven
service stations, but there will probably be more than that number. He said he was
of the opinion that service stations in neighborhood shopping centers are ideal
because this location isolates them from adjoining residential uses. If a service
station 1e located on the east side of First St, it will jump the street barrier.
Mr. Norman Wornow spoke in opposition to Mr. Blayney's remarks. Mr. William Gale,
attorney for several First St. property owners, spoke on behalf of the appliceate
for rezoning, and stated that the matter of precedent should not be of importance
since the Planning Commission and City Council have control over future applications.
He also stated that the east side of First St. is not suitable for multi-family
residential use. Mr. Paul Zeanah, representing the Chamber of Commerce, spoke in
clarification of their letter read earlier in the meeting. There being no further
comments frnm the audience, it was moved by Commissioner Johnston, seconded by Com-
missioner Lozano, and carried, that the public hearing be closed. In response to a
question by Commissioner Johnston, Mr. Blayney stated that logical locations for
ae:.vi.ce stations would be along the Del Valle Parkway and in the Vintage Hills
ahopying center. In response to a question by Coms+iscioner Rega, Mr. Campbell stated
that the realignment of First St. and Vineyard Ave. is being considered, but there
ie no definite plan at this time. Upon inquiry of Commissioner Antonini, City
Attorney Struthers read hie opinion on the First St. area, dated April 12, 1965,
as submitted to the City Council. Mr. Gale requested a decision be made on the
subject land use designation, as the General Plan has now been adopted. Mr. Blayney
said a clear-cut decision should be made whether the area in question should be
designated commercial or not, it should not be zoned partially commercial. After
diecusaian by the Commies ion, upon motion of Chairman Landon, seconded by Commis-
sioner Rega, tl.~e following resolution was adopted by the following vote: AYES:
Commissioners Antonini, Lozano, ;3ega, and Chairman Lsndon; N0: Commissioner Johnston;
ABSENT: None.
?i"SOLVJ."i.ON I40. 416
WAEREA.S, the Cit•~ Plsnni.ng Commission, oa its can motion, has considered
amendment to the Pleasan>.on Gen^ral Plan assigning a land use
designation to the area between Vineyard and Kottiager Avenues, east of
First St., now designated "Held For Further Consideration" on said General
Plan;
NOW, THEREFORE, BE IT RrSCLVED, that thu City Planning Commission does hereby
reccmQard for approval by the City Council that the Pleasanton
General Plan be amended to indicate a multiple residential "High Density"
deaigt:ation to the above-named area.
