<br />WHEREAS, the application of Devmar, Inc „ 268 Grand Avenue, Oakland, for
<br />an amendment to Oxd, No, 309 rezoning approximately 6'~ acres at
<br />the southeast corner of Santa Rita Road and the private road owned by the
<br />Kaiser Company, from the R-1 District to the C-N, RG-15 and R-2 Districts,
<br />has come before this Commission;
<br />NOW, THEREFORE, BE IT RESOLVED, that the above-named application for re-
<br />zoning be denied,
<br />Chairman Landon opened the public hearing on the application of the Planning Com-
<br />mission for an amendment to the Pleasanton General Plan assigning a land use
<br />designation to the area between Vineyard and Kottinger Avenues, east of First St.,
<br />now designated '$eld For Further Consideration" on said General Plan. Mr. Fales,
<br />in giving the staff report, said that the City Attorney indicated that amendment
<br />to the General Plan moat take place before any applications for rezoning of the
<br />subject area may be entertained. Mr. Falea read a letter from Mr. James Trimingham,
<br />President of the Pleasanton Area Chamber of Commerce, dated April 14, 1965, expreea-
<br />ing the view that a service station should be at First & Vineyard, with the remainder
<br />professional offices and multiple residential uses. Mr. Blayney said he believes
<br />the east Bide of First St. should be multi-family residential, and that First St.
<br />should be the boundary of the commercial area. He added that a service stallion
<br />is disadvantageous to adjoining property for residential use, and that five of the
<br />a even parcels on the east aide of First St. are too small for commercial use. He
<br />said it takes $400,000 annual business to operate a service station in a city. The
<br />1970 population of Pleasanton is estimated to be 22,000, which would support seven
<br />service stations, but there will probably be more than that number. He said he was
<br />of the opinion that service stations in neighborhood shopping centers are ideal
<br />because this location isolates them from adjoining residential uses. If a service
<br />station 1e located on the east side of First St, it will jump the street barrier.
<br />Mr. Norman Wornow spoke in opposition to Mr. Blayney's remarks. Mr. William Gale,
<br />attorney for several First St. property owners, spoke on behalf of the appliceate
<br />for rezoning, and stated that the matter of precedent should not be of importance
<br />since the Planning Commission and City Council have control over future applications.
<br />He also stated that the east side of First St. is not suitable for multi-family
<br />residential use. Mr. Paul Zeanah, representing the Chamber of Commerce, spoke in
<br />clarification of their letter read earlier in the meeting. There being no further
<br />comments frnm the audience, it was moved by Commissioner Johnston, seconded by Com-
<br />missioner Lozano, and carried, that the public hearing be closed. In response to a
<br />question by Commissioner Johnston, Mr. Blayney stated that logical locations for
<br />ae:.vi.ce stations would be along the Del Valle Parkway and in the Vintage Hills
<br />ahopying center. In response to a question by Coms+iscioner Rega, Mr. Campbell stated
<br />that the realignment of First St. and Vineyard Ave. is being considered, but there
<br />ie no definite plan at this time. Upon inquiry of Commissioner Antonini, City
<br />Attorney Struthers read hie opinion on the First St. area, dated April 12, 1965,
<br />as submitted to the City Council. Mr. Gale requested a decision be made on the
<br />subject land use designation, as the General Plan has now been adopted. Mr. Blayney
<br />said a clear-cut decision should be made whether the area in question should be
<br />designated commercial or not, it should not be zoned partially commercial. After
<br />diecusaian by the Commies ion, upon motion of Chairman Landon, seconded by Commis-
<br />sioner Rega, tl.~e following resolution was adopted by the following vote: AYES:
