THE MEETING
of
THE PLANNING COMMISSION
Pleasanton, California
April 28, 1965
The regularly scheduled meeting of the Planning Commission was called to order at
8:00 P.M., on Wednesday, April 28, 1965, by Vice-Chairmen Lozano.
ROLL CALL showed the following:
Present: Commissioners Antonini
Lozano
Rega
Secretary Falea
Absent: Commissioner Johnston
Chairman Landon arrived at the meeting at 8:10 P.M.
On motion of Commissioner Antonini, seconded by Commissioner Rega, the minutes of
the meeting of April 14, 1965, were approved as presented by unanimous vote of those
Commissioners present.
Vice-Chairman Lozano opcura the puoiic t.oa a ug on the application of Mre. Chester
Rossi, 9838 MacArthur Blvd., Oakland, for a Variance from the requirements of Ord.
No. 309, in order to construct multiple dwelling units with a reduced site width,
rear yard, Bide yard and driveway, at 492 St. John St., in an RG-15 District. Mr.
False stated that the City Council, at the meeting of April 26, 1965, discussed the
possibility of acquisition of the subject property ae the firer step in acquiring
street right-of-way for a new street parallel to Main St. The City Council author-
ized the staff to proceed in negotiations with Mra. Roeai for purchase of throved
property, hopefully with State Gas Tax funds, if and when this street is app
ae part of the select street system. Mrs. Rossi's attorney, Mr.Eric Schnurmacher,
has requested that the public hearing be continued to the meeting of May 1~, Mr.
Fales stated. It was moved by Commissioner Antonini, seconded by Commissioner Rega,
and carried, that the public hearing on the above matter be continued to the meeting
of May 12, 1965.
At this point in the meeting Chairman Landon arrived, whereupon he opened the public
hearing on the application of James Voultsides, 830 Main St., fora Conditional Uae
Permit in order to extend an existing non-conforming residential use in a C-C Dist-
rict, at 357 Ray St. Mr. False, in giving the staff report, said that the owner
applied for a building permit to remodel the existing structure and was informed
that a Conditional Uae Permit would be required. The staff believes that it seems
unlikely that a great change in the residential character of Chia street will occur
in the immediate future, and since the residential use has not been discontinued
for nix months the use may be continued with a Conditional Uae Permit. The staff,
therefore, recommends approval with the possible condition of a time limit. Mr.
Spiliotopouloa was present in the audience and inquired regarding the normal time
limit, whereupon Chairman Landon informed him it ie 30 years from the adoption of
the Zoning Ordinance (1960). Thera being no further comments from the audience, it
was moved by Co®iaeioner Antonini, seconded by Commissioner Lozano, and carried,
that the public hearing be closed. After discussion by the Commission, upon motion
of Co®issioner Rega, seconded by Commissioner Lozano, the following resolution
was adopted by unanimous vote of those Commissioners present:
RESOLUTION N0. 419
Conditional Uae Permit in order to extend an existing non-
conforming residential use in a C-C District, at 357 Ray Street, has
come before this Co~iseion;
NOW, THEREFORE, BE IT
RESOLVED, that the above-named Conditional Use Permit is hereby
approved, with the condition that said residential use
moat conform with all other applicable City ordinances, rules and
regulations.
