M I N U T E S <br />of <br />THE MEETING <br />of <br />THE PLANNING COMMISSION <br />Pleasanton, California <br />April 28, 1965 <br />The regularly scheduled meeting of the Planning Commission was called to order at <br />8:00 P.M., on Wednesday, April 28, 1965, by Vice-Chairmen Lozano. <br />ROLL CALL showed the following: <br />Present: Commissioners Antonini <br />Lozano <br />Rega <br />Secretary Falea <br />Absent: Commissioner Johnston <br />Chairman Landon arrived at the meeting at 8:10 P.M. <br />On motion of Commissioner Antonini, seconded by Commissioner Rega, the minutes of <br />the meeting of April 14, 1965, were approved as presented by unanimous vote of those <br />Commissioners present. <br />Vice-Chairman Lozano opcura the puoiic t.oa a ug on the application of Mre. Chester <br />Rossi, 9838 MacArthur Blvd., Oakland, for a Variance from the requirements of Ord. <br />No. 309, in order to construct multiple dwelling units with a reduced site width, <br />rear yard, Bide yard and driveway, at 492 St. John St., in an RG-15 District. Mr. <br />False stated that the City Council, at the meeting of April 26, 1965, discussed the <br />possibility of acquisition of the subject property ae the firer step in acquiring <br />street right-of-way for a new street parallel to Main St. The City Council author- <br />ized the staff to proceed in negotiations with Mra. Roeai for purchase of throved <br />property, hopefully with State Gas Tax funds, if and when this street is app <br />ae part of the select street system. Mrs. Rossi's attorney, Mr.Eric Schnurmacher, <br />has requested that the public hearing be continued to the meeting of May 1~, Mr. <br />Fales stated. It was moved by Commissioner Antonini, seconded by Commissioner Rega, <br />and carried, that the public hearing on the above matter be continued to the meeting <br />of May 12, 1965. <br />At this point in the meeting Chairman Landon arrived, whereupon he opened the public <br />hearing on the application of James Voultsides, 830 Main St., fora Conditional Uae <br />Permit in order to extend an existing non-conforming residential use in a C-C Dist- <br />rict, at 357 Ray St. Mr. False, in giving the staff report, said that the owner <br />applied for a building permit to remodel the existing structure and was informed <br />that a Conditional Uae Permit would be required. The staff believes that it seems <br />unlikely that a great change in the residential character of Chia street will occur <br />in the immediate future, and since the residential use has not been discontinued <br />for nix months the use may be continued with a Conditional Uae Permit. The staff, <br />therefore, recommends approval with the possible condition of a time limit. Mr. <br />Spiliotopouloa was present in the audience and inquired regarding the normal time <br />limit, whereupon Chairman Landon informed him it ie 30 years from the adoption of <br />the Zoning Ordinance (1960). Thera being no further comments from the audience, it <br />was moved by Co®iaeioner Antonini, seconded by Commissioner Lozano, and carried, <br />that the public hearing be closed. After discussion by the Commission, upon motion <br />of Co®issioner Rega, seconded by Commissioner Lozano, the following resolution <br />was adopted by unanimous vote of those Commissioners present: <br />RESOLUTION N0. 419 <br />.__.-_ <br />WHEREAS, the application of James Voulteides, 830 Main St., for a <br />Conditional Uae Permit in order to extend an existing non- <br />conforming residential use in a C-C District, at 357 Ray Street, has <br />come before this Co~iseion; <br />NOW, THEREFORE, BE IT <br />RESOLVED, that the above-named Conditional Use Permit is hereby <br />approved, with the condition that said residential use <br />moat conform with all other applicable City ordinances, rules and <br />regulations. <br />
