Commissioner Rega discussed the General Plan as one proposed from now until 1980, <br />and that it ie impossible Co zone all lend immediatelq. The position of the land <br />owners is understood but will take time to get all the problems solved. Chairman <br />Landon pointed out Chet if property is improved now, and at a later time the park- <br />way 1a designed to go through the improved property, that all parties would be hurt. <br />Mr. Amaral stated that there wee a law that protected the property owner and <br />guaranteed obtaining attest width linen for hie convenience in improving hie <br />property. Mr. Struthers pointed out that the City cannot take private property <br />for public use, and that any property owner who felt that hie property was being <br />used against hie will, for public purposes, could sue for inverse condemnation. <br />Re went on to say that the basic zoaiag regulations that do this have to be <br />reasonable. Chairman Landon suggested that the ezea in question be zoned Interim <br />R-1, and a request to the City Council to appropriate funds to define lines on <br />the General Plan be made. At the same time a study be made by Livingston and <br />Blayney concerning the phasing of RG arses eo thaC we know haw Bch area we can <br />expect to go to RG each year. That way property owners will know what to expect. <br />There being no further discussion, upon motion of Chairman Landon, seconded by <br />Commissioner Rega, the following resolution wen adopted by unanimous vote. <br />RESOLUTION N0. 461 <br />RESOLVED: <br />The City Planning Commission hereby recommends to the <br />City Council that all the Area of Annexation No. 38, <br />Stanley Blvd., Annex "B", and the parcel of property <br />at 4160 Stanley Blvd., owned by J. A. Comer, 1949 <br />West Winton, Hayward, be coned R-1. <br />In connection with the above, upon motion by Chairmen Landon, seconded by Commis- <br />sioner Antonini, with the following vote; AYES: Chairman Landon, Commisaionera <br />Antonini and Johnston; NOFS: Commdeaioner Rega; the following reeolncinn was <br />adopted: <br />RESOLUTION N0. 462 <br />RESOLVED: <br />The City Plenniag Commission hereby recommends to the <br />City Council that they appropriate money to final the <br />alignment of the Arzoyo Del Valle Parkway so that the <br />Planning Commtaeion and Owners will know its precise <br />boundaries; and that they also finance a study by <br />Livingston and Bleyney on the phasing of RG zoning <br />over the next 30 years. <br />Chairman Landon opened the public hearing on the application of the Planning <br />Comsiaaion for an Amendment to Osd. No. 309 assigning Zoning Districts to the <br />Area c~~ Annexation No. ~9, "Lynnewood Annex", continued from August 11 and <br />Sepreaiber g. Mr. Campbā¢a t gave the staff report, stating this ie the property <br />of Mr. & Mrs. Stuart on 1'oowhi.ll Road which was annexed at their request. The <br />staff recaommended thin prnpQrty be zoned A (Agriculture). There being no comments <br />from the audience, it w!:^ roved by Commissioner Johnston, seconded by Commissioner <br />Raga, and carried, that the public hearing be closed. After consideration by the <br />Co®ieaion, upon motion by Commissioner Antonini, seconded by Commissioner Johns- <br />ton, the following resolution was adopted by unanimous vote: <br />RESOLUTION N0. 463 <br />RESOLVED: <br />The City Planning Commission hereby recommends to the <br />City Council that the Area of Annexation No. 39 <br />"Lynnewood Annex", property owned by Mr. ~ Mrs. Stuart <br />on Foothill Road, be zoned "A" - Agriculture. <br />Chairmen Landon opened the public hearing on the application of D. N. Rinta, <br />5464 San Juan Way, fora Variance from Section 6.500, Ord. No. 309, in order to <br />allow a reduced sear-yard setback in connection with the installation of a patio <br />cover, at the above address in an R-1 District. Mr. Campbell presented the staff <br />report, stating that the applicant proposes 16 feet between the supports for the <br />cover over the patio and the rear lot line. There being no comments from the <br />audience, it was moved by Commissioner Johnston, seconded by Co®issioner Rega, <br />2. <br />
