RESOLUTION N0. 7~ <br />1,1[~ REAS the application of D & V Builders, 6000 Telegraph <br />Avenue, Oakland, for an amendment to Ordinance No. <br />309 amending the district boundaries of the Zoning <br />Map by redesignating approximately 41 acres located <br />on the east side of Hopyard Road between Black <br />Avenue and Valley Avenue from an "A" (Agricultural) <br />District to C-N, C-0, RG-15, RG-25, and R-2 (Com- <br />mercial and Multi-family Garden Apartment) Districts <br />has come before this Coaeaission: <br />NOW, THEREFORE, BE IT <br />RESOLVED: that the above named application be approved subject Co <br />the following condition: <br />1. That the applicant re-submit a description of <br />the various districts as they will be affected <br />by the realignment of Valley Avenue as indi- <br />cated on the Tentative Map Tract 2905. <br />Z-67-52. <br />UPON MOTION OF COMMISSIONER ARNOLD, SECONDED BY COMMISSIONER GARRIGAN, AND <br />CARRIED, IT WAS DETERMINED THAT Z-67-52, ZONING PERMIT WITH PLANNED UNIT DEVELOP- <br />MENT BE APPROVED L7ITH THE FOLLOWING OBJECTIVES, DEVELOPMENT CONDITIONS, AND <br />MODIFICATIONS, DELETIONS OR ADDITIONS TO ZONING ORDINANCE N0. 309: <br />1. Should development plans be submitted after the approval of the proposed <br />zoning ordinance, the zoning permit will become void and reapproval of the <br />R-2 and RG Districts shall be obtained from the Planning Commission. <br />OBJECTIVES <br />1. To plan for a variety of land uses and residential densities that will <br />be complementary and compatible with one another and the surrounding area <br />in conformance with the adopted General Plan. <br />2. To establish and design use areas that can be developed in phases or as <br />a unit independently of one another while still achieving total site <br />integration and compatibility with sufficient flexibility to meet future <br />changing market demand. <br />3. To establish reasonable limits for proper design integration of the various <br />future land use areas and to insure development of these areas in such a <br />way that existing adjacent residential areas maintain privacy, integrity, <br />and long-term value as desirable residential neighborhoods. <br />DEVELOPMENT CONDITIONS <br />1. The required standards of the zoning and subdivision ordinances shall pre- <br />vail except where modification is permitted under the P.U.D. provisions <br />or where the Planning Commission deems deviation is desirable to achieve <br />superior design, amenity and aesthetic quality. <br />2. One-story structures shall adjoin property line of any existing single-family <br />uses on abutting property, except two-story single family shall be permitted. <br />3. One side of the extension of Northway through the proposed development shall <br />be designed and constructed as a landscaped pedestrian way. The standard <br />street cross section shall be modified to accommodate this feature. De- <br />tailed landscape and street plans and specifications subject to review <br />and approval by the City Engineer. <br />4. Preschool park area subject to subsequent review and approval by the Cite <br />Recreation and Park Commission. <br />5. The following conditions shall apply to development of commercially-zoned <br />C-N and C-0 areas: <br />a. Uses shall be limited to those allowed by the Zoning Ordinance at the <br />time of development. <br />b. All buildings and structures, including service stations, in the C N <br />and C-0 zone shall follow a single design theme utilizing similar <br />-2- <br />
