RES0LUTION N0, 736 <br />WHEREAS, the application of Rainier Construction Company, <br />6000 Telegraph Avenue, Oakland, for a Variance to <br />Section 6.50 (V-67-52) to allay the construction <br />of a single family home to encroach 1 foot into <br />the required rear yard at 2388 Willer Way, <br />Pleasanton, has cane before this Commission, <br />NOW, THEREPORE, BE IT <br />RESOLVED: that Che above application be approved with <br />the following condition: <br />1. That the Variance is granted for the property <br />described in the application and any attach- <br />ments thereto, and as shown on the plot plan <br />submitted labelled Exhibit A. <br />Sc. V-67-53, Al Stewart. <br />Chairman Antonini opened the public hearing on the application of AL Stewart, <br />2834 La Rhee Drive, fora Variance to Section 7.500 to permit the construction <br />of a front porch and garage to encroach into the required side yard setback <br />4 feet, at that property known as 1117 Kottinger Drive. Mr. Castro presented <br />the staff report which stated that the applicant had previously been given <br />approval on the plans, and that the need for the Variance had been overlooked. <br />Mr. Castro presented some changes proposed by the applicant for the roof line, <br />which the Commission reviewed. The possibility of two driveways rather than <br />a single driveway was discussed with the applicant. After further discussion, <br />the Commission denied the proposal for a different roof line unless the appli- <br />cant wished to submit a new set of plans, which the applicant did not wish to <br />do. Upon motion of Chairman Antonini, seconded by Commissioner Plato, the <br />public hearing was closed. Upon motion of Chairman Antonini, seconded by <br />Commissioner Plato, the following resolution was adopted by unanimous vote: <br />RESOLUTION N0. 737 <br />WHEREAS, the application of Al Stewart, 2834 Ia Rhee Drive, <br />San Jose, for a Variance to Section 7.500 to permit <br />the construction of a front porch and garage to encroach <br />into the required side yard setback 4 feet, at 1117 <br />Kottinger Drive, has came before this Commission: <br />NOW, THEREPORE BE IT <br />RESOLVED: that the above application be approved. <br />Next was the application of Stoneaon Development Corporation, 3150 20th Avenue, <br />San Francisco, for a Zoning Permit to Install a "Stoneridge" Tract entry <br />structure to be located at Muirwood Drive and Foothill Boulevard. Mr. Castro <br />presented the staff report and proposed plans. The Commission expressed <br />concern as to who would assume responsibility for maintenance of the entry <br />structure and surrounding landscaping. Mr. Gillette, representing the <br />Stoneson Company, stated the possibility of a Homeowner's Association assum- <br />ing maintenance in the future. Mr. Struthers suggested a future review of <br />the matter before the tract company leaves, and affixing responsibility for <br />maintenance at that time. UPON MOTION OF CHAIRMAN ANTONINI, SECONDED BY <br />COMCIISSIONER GIBBS, IT WAS DECIDED TO APPROVE Z-67-79 SUBJECT TO THE FOLLOW- <br />ING CONDITIONS: <br />1. That the permit is granted for the land as described in the application <br />and any attachment thereto and as shown on the plot plan submitted labeled <br />Exhibit A. <br />2. That maintenance of the tract entry sty :pure on private property shall <br />be maintained by the developer and the prolerty owner. <br />6b. 2-67-87~. Qhris Be~atlis. <br />Next was the application of Chris Beratlis, 550 Main Street, for a zoning permit <br />to convert an existing use (grocery store) to a delicatessen and specialty <br />sandcaich restaurant, to be located at 405 Main Street in a C-C District. Mr. <br />Corley, representing the applicant, expressed concern that Condition d4 would <br />be too limiting for resale of the property.
