4. CHARGES AND TAXES <br /> <br /> AGENCY agrees to pay MFS within thirty (30) days of receipt <br />of an invoice for the Software including any related sales tax, <br />Installation Support, Training, and for all other charges listed <br />in the SCHEDULE and in accordance with the letter agreement. <br /> <br />5. CUSTOM PROGRAMMING SERVICES <br /> <br />5.B Any custom programming services requested by AGENCY will be <br />provided, if available, at MFS's then standard rates. <br /> <br />5.C AGENCY agrees to advise MFS in writing of the precise nature <br />of any suspected error or malfunction and provide MFS with all <br />relevant information upon request in order to assist MFS in <br />correcting the problems. MFS does not represent or warrant the <br />service results or that all errors or malfunctions will be <br />corrected. <br /> <br />5.D AGENCY will provide MFS with reasonable computer time and/at <br />MFS's request to help determine and correct any error or <br />malfunction, or making other changes requested by AGENCY and agreed <br />to by MFS. <br /> <br />5.E If MFS determines there was no error or malfunction in the <br />Licensed Program, AGENCY agrees to pay for all time and material <br />spent by MFS in attempting to determine and correct AGENCY's <br />problems. <br /> <br />5.F MFS has no obligation to maintain, support, or provide <br />programming services for any Licensed Program beyond the <br />specification of the most current version of the Software. <br /> <br />6. PERMISSION TO COPY, MODIFY AND USE <br /> <br />6.A Any Software furnished by MFS in machine-readable form may be <br />copied in whole or in part by AGENCY for use with the Designated <br />Computer System; HOWEVER, only the number of copies required to <br />serve AGENCY's actual need for the Designated Computer System shall <br />be made. AGENCY agrees that the original copy of all Software <br />furnished by MFS and all copies thereof made by AGENCY are and <br />shall remain the sole property of MFS. <br /> <br />6.B An original or a copy of the Software may be kept in storage <br />at a location separate from that of the Designated Computer System. <br />AGENCY agrees to notify MFS immediately in writing of the location <br />of such backup, original or a copy upon request by MFS. <br /> <br /> <br />
