M I N U T E S <br />Planning Commission <br />Pleasanton, California <br />January 24, 1968 <br />The regularly scheduled meeting of the Planning Commission was called to order <br />at 8:00 P. M. by Chairman Antonini on Wednesday, January 24, 1968. <br />ROLL CALL showed the following: <br />Present: Commissioner Arnold <br /> Garrigan <br /> Gibbs <br />Chairman Antonini <br />Secretary Castro <br />Absent: Commissioner Plato <br />APPROVAL OF MINUTES <br />UPON MOTION OF COMMISSIONER ARNOLD, SECONDED BY COMMISSIONER GIBBS, AND CARRIED, <br />IT WAS DETERMINED TO APPROVE THE MINUTES OF JANUARY 17, 1968, AS PRESENTED. <br />3.) Mr. Richard Hickman, representative of Pleasanton Homeowners Association, <br />read a letter to the Planning Commission which was mailed to the City Council, <br />expressing their support of the City Council proposal, RZ-67-16, for rezoning <br />on Black Avenue. <br />4.) Mr. Castro read a letter from Mrs. Barbara Marshall, asking for an inter- <br />pretation of the C-T District. It was decided to consider this item under <br />Item 7c. <br />Sa.) R7,-67-14, Planning Commission. <br />Reconsideration of the Planning Commission's decision for an amendment to <br />Ordinance No. 309 amending the Zoning Map to zone portions of the area. of <br />Annexation No. 49 to Agricultural, Single Family, and Commercial Thoroughfare <br />Districts. Mr. Castro informed the Commission that the matter had been referred <br />to the City Council November 13, 1967, concerning the recommendation for re- <br />zoning of portions of Annexation 49. Mr. Castro stated that until the outcome <br />of Annexation No. 56 is settled, the staff recommended continuing reconsidera- <br />tion of Annex 49. UPON MOTION OF COMMISSIONER GARRIGAN, SECONDED BY COMMISSIONER <br />ARNOLD, AND CARRIED, IT WAS DETERMINED TO CONTINUE CONSIDERATION OF ANNEX 49 <br />TO THE MEETING OF FEBRUARY 14, 1968. <br />Sb.) UP-67-24, Western Sierra Lumber Comoany. <br />Chairman Antonini opened the public hearing on the application of Western <br />Sierra Lumber Company, P. O. Box 279, Pleasanton, for a Conditional Use Permit <br />to allow the operation of a Retail and Wholesale Building Materials yard at <br />the northwest corner of Santa Rita Road and Valley Avenue. Mr. Castro explained <br />to the Commission that under Use Permit UP-67-24, the Cormnission should only <br />consider the application as a request to make the non-conforming use legal. <br />Mr. Castro stated that Western Sierra Company will come in with a new applica- <br />tion if they decide to erect a new building. Mr. Struthers informed the <br />Commission they could make a decision concerning amortization now, and it would <br />affect the new building. A representative of Mr. Johnson stated the company <br />on;.y wished to legalize the non-conforming use, and would come in later with <br />a new permit for future building. Mr. Struthers explained that the Commission <br />could set a shorter time limit on the use, than required by Ordinance No. 3C~, <br />as long as the use period gave the property owner a reasonable time to amortize <br />his investment. There was considerable discussion whether the Commission should <br />wait to set a time Limit to the use until the future building plans were sub- <br />mitted. Upon motion of Commissioner Garrigan, seconded by Chairman Antonini, <br />the public hearing was closed. Upon motion of Commissioner Arnold, seconded by <br />Commissioner Garrigan, the following Resolution cogs adopted by unanimous vote: <br />-1- 1-24-68 <br />
