<br />RESOLUTION N0. 812 <br />WHEREAS, application of Larry Riera for a zoning permit <br />to allow erection of a sign at 125-C West Neal <br />Street, has come before this Commission, <br />NOW, THEREFORE, BE IT RESOLVED that 2-68-52 be denied as submitted, <br />and that applicant resubmit design for new sign <br />to the Planning Director for approval. <br />8. COMMUNICATIONS <br />Upon request from Secretary Castro, Assistant Planner Aiello advised the <br />Commission that the proposed joint meeting between the Livermore Planning <br />Commission and the Pleasanton Planning Commission has been tentatively <br />scheduled for September 18, 1968. An agenda will be sent out to all interested <br />parties. <br />7~.MATTERS FOR INFORMATION OF COMMISSION <br />a. <br />Basically, a law has been created by the State of California to allow <br />any property to be placed in an agricultural preserve. The State is also <br />offering a "tax break" incentive to those properties involved, with the <br />property tax based on the farming assessment method. The preserve is £or <br />a period of 10 years, and if the property is developed prior to that time, <br />then it is mandatory that back taxes be paid on said property based on <br />each year's assessment. The procedure to get one's property into the <br />agricultural preserve arrangement consists of application to the County, <br />publication of a Notice of Public Hearing, hold a Public Hearing with <br />action referred to the County. <br />b. Code Chance - Wood Shinalea <br />Memo from Fire Department to Planning Commission. Mr. Aiello, representing <br />the Planning Department, clarified their position regarding wood shingles, <br />which differs from that of the Public Works Department. It has never been <br />the intent of the Planning Department to recommend wood shingles indis- <br />criminately in all locations regardless of fire zones and public safety. <br />It is the intent of the Planning Department to ask the Planning Commission <br />to recommend to the City Council that they consider the possibility of <br />adopting a policy that would permit variation to the building code insofar <br />as the use of wood shingles is concerned, depending on the area and fire <br />zones involved. Planning feels that variation is necessary to avoid the <br />stereotyping of enviro~ent that can so easily take place. There was <br />some question on this and the opinion of the Planning Department was <br />repeated. After Planning's position was clarified, Commissioner Gibbs <br />agreed that this policy would be a sound one and that the suggestion <br />should be made to City Council. <br />14.MATTERS INITIATED BY COPIIlISSION MEMBERS <br />a. Vice Chairman Plato inquired of the staff as to whether or not sign <br />applications could not be referred to the Design Review committee. <br />The staff advised Vice Chairman Plato and the Commission that this is <br />a possibility pending review of the present ordinance requirements. <br />It was moved by the Commission as a whole that if the ordinance allows <br />this flexibility, that all signs be referred to the Design Review Board <br />for approval. <br />b. Commissioner Gibbs mentioned that he had observed an overabundance of <br />signs at the service station on Ray Street right off Main Street. <br />During the discussion that ensued, it was determined that there perhaps <br />were several nonconforming signs and that the Planning staff should <br />check them out, in particular, the Shell and Standard stations on <br />Santa Rita and Valley. Note was made, and this item will be taken care <br />of by the Planning Department. <br />There being no further business, upon motion of Commi ner Carrigan, <br />by Vice Chairman Plato, and carried, the meet jou njat 8: <br />2 - <br />
