Charles Lehmann
Application of Charles Lehmann, 1851 Magellan Drive, Oakland, for a variance
to Section 2.100 to allow a reduction in the site area per dwelling unit frow
1500 sq.ft, to 1477 sq.ft., at property located at 852 Division Straet
(Continued from June 12, 1968). Mr. Castro explained the variance requested.
The sole reason why this item was being presented was because of the dedi-
cation of a strip of land on Division Street to the City for the ultimate
widening of said street, making it impossible to comply with the lot area.
The reduction amounts to approximately 23 ft. per unit. Since the City is
requesting the widening of Division Street, the applicant should receive
consideration. Applicant has complied with all reco®sendationa otherwise.
Commissioner Plato questioned whether .plans had gone before the Design
Review Board. They had. Mr. Castro explained the plan to the Commission.
Commissioner Plato inquired as to how close the building would be to the
property line. The front will be 23 ft. and the total sideyard (northerly
property line is approximately 22 ft. ). The sideyard setback on south aide
is 8 ft. The rear yard is more than adequate. The ordinance does allow
encroachment of parking to the rear setback. There was no opposition from
the audience.
RESOLUTION N0.793
WHEREAS, the application of Charles Lehmann, 1851 Magellan Drive,
Oakland, fora variance to Section 2.100 to allow a
reduction in the site area per dwelling unit from
1500 aq.ft., to 1477 aq.ft., at the property located at
852 Division Street, has come before this Commission,
NOW, THEREFORE, BE IT RESOLVED, that the above application be approved
subject to the following conditions:
1. That the permit is granted for the property as described
in the application and any attachments thereto, and as shown
on the attached plan labeled Exhibit A.
