CITY COUNCIL OF THE CITY OF PLEASANTON ALAMEDA COUNTY, CALIFORNIA RESOLUTION NO. 89-484 RESOLUTION UPHOLDING THE APPEAL OF ST. AUGUSTINE'S CHURCHAS FILED UNDERAP-89-17 (Z-89-333) WHEREAS, at the meeting of July 26, 1989, the Design Review Board approved Case Z-89-383, the application of St. Augustine's Church for design review approval of landscaping improvements for the church complex at 3999 Bernal Avenue; WHEREAS, one of the conditions of approval requires that the applicant install a sidewalk along the Bernal Avenue frontage of the site prior to installation of the landscaping; and WHEREAS, the applicant asked that the requirement that the applicant install the sidewalk be reconsidered by the Design Review Board; and WHEREAS, at its duly noticed public hearing of' October 11, 1989, the Design Review Board considered all public testimony, relevant exhibits, and recommendations of the City staff concerning this matter and denied the applicant's request for reconsideration; and WHEREAS, within the time specified by the Pleasanton Municipal Code, St. Augustine's Church submitted an appeal concerning this condition to the City Clerk of the City of Pleasanton; and WHEREAS, a public hearing was held before the City Council on November 21, 1989 at which time all pertinent testimony and documents were reviewed; and WHEREAS, based on the preponderance of evidence, the City Council finds that this appeal should be granted and the decision of the Design Review Board, concerning the applicant's installing the sidewalk, be reversed. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES AS FOLLOWS: Section 1. Approves Case Z-89-383, the application of St. Augustine's Church for design review approval of landscaping improvements for the church complex at 3999 Bernal Avenue, but deletes therefrom the condition that the applicant install a sidewalk along the Bernal Avenue frontage of the site prior to installation of the landscaping.
