EXHIBIT B <br />CONDITIONS OF APPROVAL <br />PCUP-182, Barnabas Nagy <br />2001 Ruby Hill Boulevard <br />June 19, 2007 <br />1. Approval of this conditional use permit shall be contingent upon approval of the <br />PUD development modification, Case No. PUD-93-02-09M. <br />2. The operation of the proposed restaurant shall be in substantial conformance to <br />the written narratives, dated "Received April 20, 2007" on file in the Planning <br />Department, except as modified by the following conditions. Minor changes to <br />the operation may be allowed subject to the approval of the Planning Director if <br />found to be in substantial conformance to the approved exhibits. <br />3. <br />The proposed facility shall conform to the following hours of operations: <br />Dining Hours: <br />Sunday- Thursday: <br />Friday/Saturday, and the day <br />before a federal holiday: <br />Private Functions: <br />Daily: <br />4. <br />6:00 p.m. to 10:00 p.m. <br />6:00 p.m. to 11:00 p.m. <br />11:00 a.m. - 5:00 p.m. <br />Any outdoor-related events shall conclude by no later than 9:00 p.m. daily. <br />Additional hours and activities beyond that stated may be approved by the <br />Planning Director if found to be in substantial conformance with the approval. The <br />Planning Director may also refer the matter to the Planning Commission if the <br />proposed changes would be significant. <br />Valet parking shall be provided during private functions and shall not block or <br />impede any emergency vehicle access. <br />5. Acoustic-only, non-amplified music /voice accompaniment, e.g. acoustic guitar or <br />piano, shall be allowed outside the building. A string quartet shall also be allowed <br />to play outside the building. <br />6. Amplified musical instruments and DJ's shall only allowed indoors. <br />1 <br />
