PLANNING COMMISSION CITY OF PLEASANTON <br />ALAMEDA COUNTY, CALIFORNIA <br />RESOLUTION NO. 2864 <br />RESOLUTION APPROVING CASE UP-86-45, APPLICATION OF <br />WARMINGTON HOMES FOR A SUBDIVISION SALES OFFICE <br />WHEREAS, Warmington Homes has applied for a conditional use <br />permit to operate a subdivision sales office in a <br />temporary trailer facility to be located at 17 Foothill <br />Lane; and <br />WHEREAS, zoning for the property is R-1-20,000 (Single-family <br />Residential) District; and <br />WHEREAS, model home complexes are categorically exempt under <br />CEQA. For this reason, no environmental document <br />accompanies this report; and <br />WHEREAS, the Planning Commission made the following findings: <br />A. That the proposed location of the conditional use <br />is in accordance with the objectives of the <br />Municipal Code and the purposes of the district in <br />which the site is located. <br />The sales trailer will not interfere with the <br />purposes of the R-1-20,000 Single-family <br />Residential District and is a necessary use for the <br />selling of the units. Although the closest <br />residence (19 Foothill Place) is 50 feet from the <br />proposed trailer location, the trailer's <br />orientation toward the street and the hours of use <br />will assure that it will not create significant <br />traffic, noise, and other nuisances to adjoining <br />homes. Indeed, there are only G remaining lots in <br />the subdivision and the applicant expects that most <br />will be sold in a very short time. <br />B. That the proposed location of the conditional use <br />and the conditions under which it would be operated <br />or maintained will not be detrimental to the public <br />health, safety, or welfare, or materially injurious <br />to the properties or improvements in the vicinity. <br />City staff has determined that no adverse effects <br />are generated by this type of use in similar <br />residential locations. Indeed the use will be <br />somewhat limited since the sales office will only <br />be open 10 a.m. to 5 p.m. For these reasons, the <br />project will not be detrimental to the public <br />health, safety, or welfare, or materially injurious <br />to the properties or improvements in the vicinity. <br />- 1 - <br />
