LICENSE KAISER SAND AND GRAVEL THIS LICENSE, is made and entered into this day of October, 1989, by and between the CITY OF PT~ASANTON, a California municipal corporation, hereinafter referred to as Licensee, and KAISER SAND AND GRAVEL, a Delaware corporation, hereinafter referred to as Licensor. WITNESSETH In consideration of the promises, agreements, and payment herein set forth, the parties mutually agree as follows: 1. Licensor allows Licensee the use of storm drainage storage and assorted underground piping for said storm drainage on the following described premises situated in the County of Alameda, State of California: That certain area shown on plot plan attached hereto (Exhibit "A") and made a part of this License. 2. The term of this License shall be for one year, commencing when the storm drain pipeline begins construction on the subject property, but no later than November 1, 1990. The term can be extended for an additional one year period, every November 1. If the Licensee has not renewed the license of the subject property by November 10th, Licensor shall notify Licensee accordingly and grant an extension for ten (10) days in order to renew. Licensee shall have the right to terminate the License by providing a sixty (60) day notice to the address stated in paragraph 10 of this License. Licensor shall have the right to cancel the License by providing one year written notice to terminate the Licensee after the first year has expired. Notice shall be sent to the address stated in paragraph 10 of this License. 3. The annual license fee shall be Five Thousand and 00/ths Dollars ($5,000.00) payable on the annual renewal date of November 1. The fee shall be prorated from the time the Licensee begins construction on the subject land or terminates the agreement or from when the Licensor terminates the License by providing the one year notice to terminate the License. -1-
