THE CITY OF <br />-' -- ' " ' -'- ~~ CITY COUNCIL AGENDA REPORT <br />j~L£~AS~4NTONo <br />June 19, 2007 <br />Department of Public Works <br />TITLE: ACCEPTANCE OF PUBLIC IMPROVEMENTS PERFORMED BY HSR <br />GENERAL ENGINEERING CONTRACTORS INC. FOR THE BERNAL <br />CREEK RESTORATION PROJECT, CIP NO. 037049. <br />SUMMARY <br />Construction of the subject project is complete and is ready for acceptance. The <br />subject project consists of the restoration of several creeks within the Bernal Property. <br />HSR Engineering Contractors Inc. was awarded the project by City Council on July 18, <br />2006, in the amount of $1,524,140. Additionally, on September 19, 2006, City Council <br />authorized the transfer of funds form the Bernal Park Project No. 007065 in the amount <br />of $105,000 to provide for the import of soil fill material from the creek excavation to the <br />future Bernal Park Sports Field Project (Phase I). This work associated with the Bernal <br />Park Sports Field (stockpiling of fill material) has also been completed. <br />RECOMMENDATION <br />1. Accept the improvements for the subject project. <br />2. Authorize the City Clerk to file a Notice of Completion for the subject <br />project. <br />3. Authorize payment of the retention in the amount of $85,671.70 to HSR <br />General Engineering Contractor Inc. of Santa Clara thirty days after <br />recordation of the Notice of Completion. <br />4. Authorize final payment to HSR General Engineering Contractor Inc. in the <br />amount of $630.45. <br />FINANCIAL STATEMENT <br />Ongoing maintenance and the cost of monitoring and reporting the condition of newly <br />planted vegetation to the California Department of Fish and Game are estimated at <br />approximately $124,300 per year. Costs are divided between contractor costs to <br />perform the creek maintenance and reporting tasks, $100,000; annual cost of irrigation <br />water, $9,600; and staff costs to remove trash, maintain the pathway, and provide <br />maintenance contract oversight, $14,700. The first year's contractor costs have been <br />appropriated from the project funds, and the future year maintenance and reporting <br />funding will be from the Parks General Fund. <br />
